Confined Spaces. An employee working in a confined space (as defined) is entitled to 58 cents per hour extra.

Confined Spaces. Confined space is an enclosed or partially enclosed space that: (i) has been identified as such in a risk assessment; (ii) is not intended or designed primarily as a place of work; (iii) may have restricted entry and exit; and (iv) may (1) have an atmosphere which contains potentially harmful levels of contaminants; (2) not have a safe level of oxygen, e.g., following a nitrogen purge; or (3) cause entrapment or engulfment. • Working in confined spaces will only be allowed after written approval (permit) has been issued by the Elk Ridge OATR. • Seller shall have a rescue plan approved by the Elk Ridge OATR in place prior to working in confined spaces. • Seller and Seller Representatives required to work in a confined space, or to act as a standby person, must be trained, competent and tested.
Confined Spaces a) Seller must provide all of its employees/attendants (hole watchers) who enter confined spaces with rescue and emergency equipment, continuous atmospheric monitoring instruments, respirators, fire extinguishers, and any other equipment required by OSHA or MSHA as appropriate.
b) All project confined spaces are to be considered “permit-required” and will not be entered unless a permit is signed by BE&K or the Purchaser.
c) If a Seller employee enters a permit-required confined space, Subcontractor must have an on-site trained rescue force available as specified by OSHA or MSHA as appropriate, or have arranged for that service from the client/owner or an outside service company. Seller must check to see if rescue forces from the fire department will be on hand and include training, equipping, and the standby of rescue personnel for its personnel who may enter permit-required confined spaces.
d) If BE&K personnel are also in the confined space, BE&K will conduct continuous atmospheric monitoring. When there is no BE&K personnel in the space, the Subcontractor is required to perform initial and continuous atmospheric monitoring.
Confined Spaces. Add the following after the last paragraph: “Work operations in confined space and permit-required confined space as defined in 29 CFR 1910, Section 146 are particularly hazardous. These operations shall be specifically addressed in the Contractor’s comprehensive Project Specific Safety and Health Plan and, in the case of permit- required spaces, a supplemental plan detailing the permit-required space program that the Contractor will follow and of any hazards confronted or created in permit-required spaces. These plans shall be submitted for review prior to the start of work. Indicated confined spaces are not intended to limit or define Contractor or subcontractor regulatory compliance requirements. In addition to confined spaces indicated on the drawings, other confined spaces may be present or created by the work of this contract. The Contractor shall furnish, at no additional cost to the Thruway Authority, personnel and equipment to allow the Engineer to enter confined space and permit-required confined space in compliance with in 29 CFR 1910, Section 146.”

An employee working in a confined space which means a small compartment or place to which access is through a manhole or similar opening, or where work is done in a place the dimensions of which necessitate an employee working in a stooping or otherwise cramped or uncomfortable position, shall be entitled to 56 cents per hour extra while so engaged.
Confined Spaces. The Contractor shall have an established confined space procedure that meets the requirements of VOSH Standard 29 CFR 1910, Subpart J, §146, titled “Permit-Required Confined Spaces.” The Contractor is responsible to provide confined space air monitoring and rescue equipment, as well as any other required devices or equipment on site to all employees. The Contractor must be able to provide safety training records of its employees performing work in a confined space to the Owner upon request. The Contractor shall coordinate with the Owner’s representative to ensure the Contractor conforms to all confined space program requirement. TECHNICAL SPECIFICATIONS
