CONFLICT IN DOCUMENTS. 2.1 In the event of ambiguities, conflicts or inconsistencies between or among this Lender’s Direct Agreement, the Project Agreement, the Construction Contract and the Limited Assignment of Construction Contract, this Lender’s Direct Agreement shall prevail. Notwithstanding the foregoing, if there is any right or remedy in favour of Hospital set out in this Lender’s Direct Agreement or any part thereof which is not set out or provided for in the Construction Contract, such additional right or remedy shall not constitute an ambiguity, conflict or inconsistency. No review by Hospital of the Lending Agreements shall constitute an acceptance in or acquiescence to any of the Lending Agreements or any term or condition thereof by Hospital and this Lender’s Direct Agreement, the Project Agreement and the Construction Contract shall not be subject to any of the terms and conditions of the Lending Agreements.

CONFLICT IN DOCUMENTS. (a) In the event of ambiguities, conflicts or inconsistencies between or among this Construction Contractor’s Direct Agreement, the Project Agreement and the Construction Contract, this Construction Contractor’s Direct Agreement shall prevail.
CONFLICT IN DOCUMENTS. The terms of this Agreement shall control in the event of any conflict between the terms of this Agreement and any other agreement or document.

Notwithstanding any provision of any other Implementing Agreement, including Section 2.5(a)(iv) of the Project Agreement, no review by Owner of the Senior Lending Agreements shall constitute an acceptance of or acquiescence to any of the Senior Lending Agreements or any term or condition thereof by Owner, and this Lender’s Direct Agreement and the Project Agreement shall not be subject to any of the terms and conditions of the Senior Lending Agreements.
CONFLICT IN DOCUMENTS. In the event of a conflict between any of the Contract Documents, Contractor is not obligated to perform the more costly installation. In the event Owner opts to direct Contractor to provide a more costly installation, Owner will be responsible for extra costs incurred. Extra-Work. Any deviation from approved architectural drawings, specifications or documents will be strictly construed as work outside the Scope of this Agreement and at Contractor’s discretion will be subject to additional costs and charges to the Owner to be agreed upon by both parties to this Agreement consistent with the Proposal.
