Conflicting publications. Subject to the provisions of Clause 3.3, the Editor warrants that during the continuance of this Agreement no material written, compiled or edited by the Editor (or otherwise associated with the Editor) will be published which may reasonably be considered by the Publishers to directly compete with and/or tend to lessen the sale of the Work (excluding earlier editions of the same Work) (a ‘Conflicting Publication’), unless the Publishers have granted the Editor permission in writing for a Conflicting Publication. In addition, the Editor warrants to the Publishers that no Conflicting Publication has already been published and undertakes that he/she will not enter into (or cause any other person, such as an agent, to enter into on his/her behalf) any agreement to publish a Conflicting Publication.
