Common use of Construction Budget Clause in Contracts

Construction Budget. 1.10.1 The Owner shall provide written notice to the Contracting Authority and A/E of any change in the Construction Budget. 1.10.2 The A/E shall perform its Services so that the Project is completed within the Construction Budget. 1.10.3 The A/E, Contracting Authority, and Owner do not have control over the cost of labor, materials, or equipment, over Contractors’ methods of determining prices, or over competitive bidding, market, or negotiating conditions. Accordingly, the A/E does not warrant or represent that competitively bid or negotiated prices will not vary from the Construction Budget or from any estimate of cost or evaluation prepared, or agreed to, by the A/E.
