Common use of Consultants’ Competitive Negotiation Act Clause in Contracts

Consultants’ Competitive Negotiation Act. If the total fee paid to the T&B Firm exceeds the threshold amount provided in Section 287.017, for CATEGORY FOUR, the following provisions of the Consultants’ Competitive Negotiation Act, section 287.055(5)(a), Florida Statutes apply: A. The T&B Firm shall execute and furnish to the Owner a “Truth-in- Negotiation Certificate,” stating the wage rates and other factual unit costs supporting compensation are accurate, complete, and current at the time of executing this Agreement. B. The “Truth-in-Negotiation Certificate” form is attached to this Agreement as Exhibit G. C. The Contract Sum and any additions thereto shall be adjusted to exclude any significant sums when the Owner determines the Contract Sum was increased due to inaccurate, incomplete, or non-current wage rates and other factual costs.
