Common use of Consultants’ Competitive Negotiation Act Clause in Contracts

Consultants’ Competitive Negotiation Act. (a) If the total fee paid to the Consultant exceeds the threshold amount provided in Section 287.017, for CATEGORY FOUR, the following provisions of the Consultants’ Competitive Negotiation Act, section 287.055(5)(a), Florida Statutes apply: 1. Consultant shall execute and furnish to School Board a “Truth­in­ Negotiation Certificate” stating the wage rates and other factual unit costs supporting compensation are accurate, complete, and current at the time of executing the contract. 2. The “Truth­in­Negotiation Certificate” Exhibit F form will be furnished to Consultant by School Board upon request. 3. The original contract amount and any additions thereto shall be adjusted to exclude any significant sums when School Board determines the contract amount was increased due to inaccurate, incomplete, or non current wage rates and other factual costs.
