Continuing Privacy Obligation. Business Associate’s obligation to protect the privacy of the PHI and electronic PHI it created or received for or from Company will be continuous and survive termination, cancellation, expiration or other conclusion of Agreement.
Continuing Privacy Obligation. Broker’s obligation to protect the privacy of the Health Information or Personal and Health Information shall be continuous and survive termination, cancellation, expiration or other conclusion of this Agreement.

Notwithstanding the provisions of Part III, Section D, above, ETF and DELOITTE may mutually agree that it is not feasible to destroy or return to ETF certain specified Protected Health Information, and may provide by mutual agreement what limited use or disclosure of such information by DELOITTE may thereafter occur. DELOITTE’s obligation to protect the privacy of Protected Health Information that cannot feasibly or lawfully be returned or destroyed survives the termination of the Underlying Contract and this Addendum. Any material retained under Part III, Section E of this Addendum is perpetually subject to inspection by ETF upon reasonable notice and during DELOITTE’s normal business hours.

Broker/Producer is responsible for keeping abreast of enhancements, changes or new regulations that may be implemented by HHS/CMS (See F(2) Amendment).

Any material retained under Part III, Section E of this Addendum is perpetually subject to inspection by ETF upon reasonable notice and during GRS’ normal business hours.

Notwithstanding the preceding paragraph, DETF and Business Associate may mutually agree that it is not feasible to destroy or return to DETF certain specified Protected Health Information, and may provide by mutual agreement what limited use or disclosure of such information by Business Associate may thereafter occur. Business Associate’s obligation to protect the privacy of Protected Health Information that cannot feasibly or lawfully be returned or destroyed will be continuous and survive the termination of the Professional Administrative Services Agreement and this Addendum. Notwithstanding XVII (F) of the Professional Administrative Services Only Agreement, any material retained under Part IV (E) of this Addendum is perpetually subject to inspection by DETF upon reasonable notice and during Business Associate’s normal business hours.
Continuing Privacy Obligation. Cascade’s obligation to protect the privacy of the Protected Health Information it created or received for or from Company will be continuous and survive termination, cancellation, expiration or other conclusion of Agreement.
Continuing Privacy Obligation. BA’s obligation (and the obligation of subcontractor or agents) to protect the privacy of the PHI it created for or received from CE will be continuous and survive termination, cancellation, expiration or other conclusion of the Agreement.
Continuing Privacy Obligation. BUSINESS ASSOCIATE’s obligation to protect the privacy of COMPANY’s Protected Health Information as specified in this Addendum will be continuous and survive termination or other conclusion of Agreement.
