Common use of Continuity of Care Clause in Contracts

Continuity of Care. Provider shall cooperate with Subcontractor and Health Plan and provide a Covered Person with continuity of treatment, including coordination of care to the extent required under law, in the event Provider’s participation with Subcontractor terminates during the course of a Covered Person’s treatment by Provider.

Continuity of Care. In accordance with the Agreement and to the extent required by applicable law, regulations or the CRA, Provider shall cooperate with Subcontractor and Health Plan and provide a Covered Person Persons with continuity of treatment, including treatment (which may include coordination of care to the extent as required under law, ) in the event Provider’s participation with Subcontractor terminates during the course of a Covered Person’s treatment by Provider, except in the case such termination is due to adverse action against the Provider.

Provider shall cooperate with Subcontractor and Health Plan and to provide a newly enrolled Covered Person Persons with continuity of treatment, including coordination of care to the extent required under law, law or required to ensure that ongoing care is not disrupted or interrupted. Provider shall also coordinate with Subcontractor to ensure continuity of treatment in the event Provider’s participation with Subcontractor terminates during the course of a Covered Person’s treatment by Provider.

In the event of Provider’s insolvency or other cessation of operations, Covered Services to members shall continue through the period for which a capitation payment has been made, if any, to Subcontractor or until the Covered Person’s discharge from an inpatient facility, whichever time is greater.
