Common use of CONTRACTING OUT SERVICES Clause in Contracts

CONTRACTING OUT SERVICES. No bargaining unit employee shall be laid off, displaced (except as noted below), demoted or suffer loss of pay or benefits as a result of the contracting of bargaining unit work. The City Manager retains the codified right to transfer employees, and management shall continue to assign work to meet the service needs of the City. The City will Meet and Confer with the Union prior to the initiation of the bidding process to contract out bargaining unit work. The Union agrees that it will cooperate with the City in determining the most efficient and effective ways to accomplish work processes. Notwithstanding the above agreement, if it is mutually agreed (by the Union, employee and City) that appropriate work within the City is not available for an employee as a result of contracting out of services and the employee is separated from service, the employee will receive a separation benefit of four (4) months pay in addition to the normal termination benefits applicable to other employees covered by this Agreement.
