Common use of Contractor Drawings and Manuals Clause in Contracts

Contractor Drawings and Manuals. ‌ (a) Seller shall at all times keep a copy of the most recent version of the Contractor Drawings and Manuals at Seller’s office on the Site to be made available for Buyer’s review. In addition, Seller shall provide and make available to Buyer electronic versions of the Contractor Drawings and Manuals accessible by Buyer through a file transfer protocol site to be maintained by Seller. (b) Seller shall cause to be set forth in the Contractor Drawings and Manuals provided to Buyer such information as is required to operate and maintain the Work, including to the extent applicable, recommended operating and maintenance procedures, system descriptions, product catalogs, drawings, design sheets, specifications, logic diagrams, maintenance and instruction sections, spare parts lists, any vendor-supplied training documents, and current heat balances. The Contractor Drawings and Manuals shall be (i) prepared in accordance with the Specification and when completed, shall be in sufficient detail to accurately represent the Project as constructed. The Contractor Drawings and Manual shall be maintained and be available, with up-to-date drawings, specifications and design sheets, for the training as set forth in Section 7.11 (“Training”).‌ (c) Seller shall prepare initial system descriptions, design basis documents, and operational guidelines for the Project and deliver such to Buyer for its review at least one (1) year prior to the Guaranteed Substantial Completion Date. (d) At least sixty (60) days prior to the Guaranteed Substantial Completion Date, Seller shall provide Buyer with initial drafts of the final Contractor Drawings and Manuals for review (the “Draft Manuals”). The Draft Manuals shall contain such information described in Section 7.10(b), other than the drawings which, in accordance with this Section 7.10, are being maintained so as to be up-to-date. Two (2) complete sets of the Draft Manuals shall be provided to Buyer at least sixty (60) days prior to Substantial Completion and shall be a condition of Substantial Completion. (e) Seller shall provide to Buyer both hard and electronic final copies of the Contractor Drawings and Manuals. Seller shall provide to Buyer five (5) final hard copies of the Contractor Drawings and Manuals within sixty (60) days after achievement of Substantial Completion. Buyer shall not be required to deliver the Notice of Final Acceptance until all such Contractor Drawings and Manuals have been so delivered. (f) Any modifications to the Contractor Drawings and Manuals made necessary as a consequence of any Final Punch List items or modifications to the Work shall be issued as addenda to the Contractor Drawings and Manuals within sixty (60) days following completion thereof.

The Contractor Drawings and Manuals shall be (i) prepared in accordance with the Specification Technical Specification, Appendix F and Appendix G and when completed, shall be in sufficient detail to accurately represent the Project as constructed. The Contractor Drawings and Manual Manuals shall be maintained and be available, with up-to-date drawings, specifications and design sheets, for the training of PacifiCorp’s personnel as set forth in Section 7.11 (“Training”).‌ (c) Seller 7.10. Developer shall prepare initial system descriptions, design basis documents, and operational guidelines for the Project and deliver such to Buyer PacifiCorp for its review at least one (1) year prior to the Guaranteed Substantial Completion Date. (d) . At least sixty (60) days prior to the expected Guaranteed Substantial Completion Date, Seller Developer shall provide Buyer PacifiCorp with initial drafts of the final Contractor Drawings and Manuals for review (the “Draft Manuals”). The Draft Manuals shall contain such information described in Section 7.10(b7.9(b), other than the drawings which, in accordance with this Section 7.107.9, are being maintained so as to be up-to-date. Two (2) complete sets of the Draft Manuals shall be provided to Buyer PacifiCorp at least sixty (60) days prior to Substantial Completion and shall be a condition to the achievement of Substantial Completion. (e) Seller . Developer shall provide to Buyer PacifiCorp both hard and electronic final copies of the Contractor Drawings and Manuals. Seller Developer shall provide to Buyer PacifiCorp five (5) final hard copies of the Contractor Drawings and Manuals within sixty (60) days after achievement of Substantial Completion. Buyer PacifiCorp shall not be required to deliver the Notice of Final Acceptance until all such Contractor Drawings and Manuals have been so delivered. (f) . Any modifications to the Contractor Drawings and Manuals made necessary as a consequence of any Final Punch List items or modifications to the Work shall be issued as addenda to the Contractor Drawings and Manuals within sixty (60) days following completion thereof.

In addition, Seller shall provide and make available to Buyer electronic versions of the Contractor Drawings and Manuals accessible by Buyer through a file transfer protocol site to be maintained by SellerArticle 10. (b) Seller Contractor shall, within the time detailed in the Project Schedule or elsewhere in this Contract, submit Contractor Drawings and Manuals to Company’s Representative in hard copy and electronic form (the specific form of which shall be agreed to by the Parties). (c) Contractor shall cause to be set forth in the Contractor Drawings and Manuals provided to Buyer Company such information as is required to operate and maintain the Work, including to the extent applicable, recommended operating and maintenance procedures, system descriptions, product catalogs, drawings, design sheets, specifications, logic diagrams, maintenance and instruction sections, spare parts lists, any vendor-supplied training documents, and current heat balances. The Contractor Drawings and Manuals shall be (i) prepared in accordance with the Specification and Specifications; (ii) when completed, shall be in sufficient detail to accurately represent the Project as constructed. Without waiver of or prejudice to any rights of Company, Contractor shall bear all risk in relation to its performance of Work arising from or in relation to all Contractor Drawings and Manuals (including calculations). The Draft Manuals shall contain such information described in Section 7.10(b), other than the drawings which, in accordance with this Section 7.10, are being maintained so as to be up-to-date. Two (2) complete sets of the Draft Manuals shall be provided to Buyer at least sixty (60) days prior to Substantial Completion and shall be a condition of Substantial Completion.
