Common use of Contractor Responsibility for Construction Schedule Clause in Contracts

Contractor Responsibility for Construction Schedule. The CONTRACTOR shall be responsible for the preparation, submittal and maintenance of the construction schedules required by the Contract Documents, and any failure of the CONTRACTOR to do so may be deemed by the DISTRICT as the CONTRACTOR's default in the performance of a material obligation under Contract Documents. Any and all costs or expenses required or incurred to prepare, submit, maintain, and update the construction schedules shall be solely that of the CONTRACTOR and no such cost or expense shall be charged to the DISTRICT. The Contract Price shall not be subject to adjustment on account of costs, fees or expenses incurred or associated with the CONTRACTOR's preparation, submittal, and maintenance or updating of the construction schedules. All schedule submittals shall include electronic discs for use by the DISTRICT in its analysis and approval of the schedule submittal.
