Cost Responsibility for Network Upgrades.
5.1 Applicability No portion of this Article 5 shall apply unless the interconnection of the Small Generating Facility requires Network Upgrades.
5.2 Network Upgrades Transmission Provider or Transmission Owner shall design, procure, construct, install, and own the Network Upgrades described in Attachment 6 of this Agreement. If Transmission Provider and Interconnection Customer agree, Interconnection Customer may construct Network Upgrades that are located on land owned by Interconnection Customer. Unless Transmission Provider elects to pay for Network Upgrades, the actual cost of the Network Upgrades, including overheads, shall be borne initially by Interconnection Customer.
