Common use of Contractor’s equipment and material Clause in Contracts

Contractor’s equipment and material. The Contractor shall be responsible for all materials and equipment required for the execution of its Scope of Project as per the Programme Schedule. If and when such materials and equipment are brought on to the Site shall be deemed to be exclusively intended for the execution of the Works. The Contractor shall ensure proper safety of all workmen, material and equipment belonging to it or to the Authority or to others working at the Site. The Contractor shall also be responsible for provision of all safety notices and safety equipment required both by the Applicable Laws and the Authority. The Contractor shall also provide necessary barriers, warning signals and other safety measures while laying conduits, cables etc. or wherever necessary so as to avoid accident. The Contractor shall at all times take all reasonable precautions to maintain the health and safety of the Contractor’s Personnel. In collaboration with local health authorities, the Contractor shall ensure that medical staff, first aid facilities, sick bay and ambulance service are available at all times at the Site and at any accommodation for Contractor’s and Authority’s Personnel, and that suitable arrangements are made for all necessary welfare and hygiene requirements and for the prevention of epidemics. The Contractor shall appoint an accident prevention officer at the Site, responsible for maintaining safety and protection against accidents. This person shall be qualified for this responsibility, and shall have the authority to issue instructions and take protective measures to prevent accidents. Throughout the execution of the Works, the Contractor shall provide whatever is required by this person to exercise this responsibility and authority. The Contractor shall send, to the Authority, details of any accident as soon as practicable after its occurrence. The Contractor shall maintain records and make reports concerning health, safety and welfare of persons, and damage to property, as the Authority may reasonably required. All equipment used in construction and erection by the Contractor shall meet Indian/International standards and where such standards do not exist, the Contractor shall ensure the equipment to be absolutely safe. All equipment shall be strictly operated and maintained by the Contractor in accordance with the manufacturer’s operation manual and safety instructions. The Contractor shall dispatch materials to Site in consultation with the DTA. Suitable lockable storage accommodation shall be made available free of charge temporarily. Watch and xxxx however, shall be the responsibility of Contractor. The programme of dispatch of material shall be framed keeping in view the building progress. Safe custody of all machinery and equipment supplied by the Contractor shall be the responsibility of the Contractor till the Term of this Contract.
