Contractual Definitions. Also for the purposes and effects of this Agreement, the definitions contained in this paragraph shall also be valid whenever the following words and phrases are used in the singular or plural, in the masculine or feminine gender: Oil or Gas Availability Agreement: agreement entered into by and between the Consortium Members to govern the availability of Oil or Gas produced to the original owners. Affiliate: any controlling or controlled legal entity, under articles 1,098 to 1,100 of the Brazilian Civil Code, as well as entities under common control of the same company, directly or indirectly.
