Common use of Cooling Off Clause in Contracts

Cooling Off. The parties’ attention is drawn to the fact that Section 16 of the Consumer Protection Act, 68 of 2008 applies to this agreement. Notwithstanding any other clause in this contract, the Purchaser has the right to revoke this offer or terminate this agreement by written notice to be delivered to the Seller, or his or her agent, within five (5) working days of signature of this agreement. The Purchaser’s attention is drawn to the fact that such notice will be of no force or effect unless it is:- (i) Signed by the Purchaser or his or her agent acting on his / her authority; and (ii) Refers to this offer or agreement as the offer or agreement that is being revoked or terminated as the case may be; and
