MAINTENANCE OF THE SAID BUILDING. APARTMENT/PROJECT: The Promoter shall be responsible to provide and maintain essential services in the Project till the taking over of the maintenance of the Project by the association of Allottees upon the issuance of the completion certificate of the project. The cost of such maintenance has been included in the total price of the Apartment.

(i) The Promoter shall be responsible to provide and maintain essential services in the Project for three months from the date of Notice of possession or till the taking over of the maintenance of the entire project/all phase by the association of Allottees upon the issuance of the completion certificate of the entire project whichever is earlier. The cost of maintenance for three months from the date of Notice of Possession has been included in the Total price of the Unit. The Allottee shall commence payment of Maintenance Charges to the Promoter after lapse of first three months from the date of Partial Completion Certificate of the respective Building Block and shall continue to pay till handover of maintenance of the project to the association of allottees and thereafter to the association of allottees. In case the formation of the Association is delayed beyond the said period, due to no fault of the Developer; the Promoter shall provide and maintain only the essential services in the said Project till the Association is formed and the said Project is handed over to the Association and the Allottees shall be liable to pay to the Promoter or facility management company, the charges for such maintenance as fixed by the Promoter at actuals. Once the Association is formed and the said project is handed over to the Association the Allottee shall start payment of Maintenance Charges to the Association.

APARTMENT/ PROJECT: The Promoter shall be responsible for providing and maintaining the essential services in the Project, till the taking ove r of the maintenance of the Project by the Maintenance Society upon the issuance of the completion certificate of the Project. The cost of such maintenance has been included in the Total Price of the Apartment/ Plot. That the Promoter shallhand over the common areas to the maintenance Society with the main object to take over from the Promoter, the responsibility of maintenance of common areas as mentioned hereunder and/ or with such other object or purpose and in such manner and to such extent as the Promoter or its nominee may decide from time to time. The Allottee agrees and undertake s that he shall be abide by and comply with the bye -laws and rules and regulations of such maintenance Society. After the Promoter hands over the management/ maintenance of the common areas to the Society then it shall be the sole responsibility of the Soc iety, to run and maintain the common areas and to determine from time to time the rate and amount of combined expenses and outgoings for common amenities and common services along with the sinking fund charges, recoverable proportionately from the Allottee and from all other parties and the Allottee agrees that he shall be liable to pay the said combined expenses and outgoings for common amenities and common services along with the sinking fund charges, recoverable proportionately from the Allottee and from all other parties and other dues to the Society from time to time regularly.
10.1 The operation of service and maintenance of the said Project shall be done in accordance with the Maintenance Agreement. The Allottee agrees and undertakes to abide by the terms and conditions of the Maintenance Agreement. Till execution of Maintenance Agreement Buyer shall be bound to follow Maintenance Decisions taken by the Promoter or Maintenance Society.
10.2 The ALLOTTEE shall not raise nay objection, if any changes or modifications are made in the draft bye laws as may be required by the registrar of societies or other competent authorities as the occasion may demand.
10.3 The Allottees hereby agrees that his/ her right to use of Common areas and Facilities developed with said project or to be developed shall be subject to the timely payment of total maintenance charges and performances by the Allottees of all his/ her obligations in respect of the terms and conditions specified under this...
MAINTENANCE OF THE SAID BUILDING. APARTMENT/PROJECT
(A) Regularly and punctually the proportionate share of maintenance charges.
(B) Regularly and punctually make payment of the proportionate share of rates and taxes and other outgoings (hereinafter referred to as ‘The Rates and Taxes’).
(C) The Allottee shall not withhold payment of the same on any account whatsoever.
(D) In the event of any default the Allottee shall be liable for payment of interest at prime lending rate of State Bank Of India plus two per cent p.a. on amounts outstanding and if such default shall continue for a period of two months the Promoter or the Association as the case may be, without prejudice to their rights and contentions shall be entitled to and the Allottee shall be deemed to have consented.
(a) To the discontinuance of services.
(b) Prevent usage of the lift and prevent usage of the Recreation centre/Club and/or by Allottee and all persons claiming through him and the said services shall be restored only upon payment of all the amounts due with interest thereon as aforesaid and the Allottee assuring not to make such defaults in future.
(c) The Allottee will not be permitted to use any of the facilities and/or utilities in the Residential Complex in case the Allottee breaches any of the provisions herein till such time the breach continues.
(d) Promoter or the Association shall become entitled to all rents accruing from such Apartment if the Apartment has been let out and/or is under tenancy and/or lease.
(e) The Allottee shall not sell, transfer, alienate, assign, and/or encumber nor create any interest of third party nor part with possession of the Apartment or any part or portion thereof till such time all accounts payable are fully paid and/or liquidated with interest as agreed upon and such negative covenant will be enforceable in law.
(f) In the event of sale and transfer of the Apartment the Promoter or the Association as the case may be, will have first charge and/or lien over the sale proceeds for the purpose of realization and/or recovery of arrears together with interest accrued and due thereon.
MAINTENANCE OF THE SAID BUILDING. APARTMENT / PROJECT
(i) The Allottee(s) shall and hereby agrees to enter an agreement called the “Maintenance Agreement “ with the promoter or its nominated agency, as the promoter in its sole discretion deems fit, for smooth operation and management of the common areas,services and proper upkeep and maintenance of the common areas and facilities post completion of the project. The scope of maintenance shall broadly include operation and maintenance of lifts, generators, fire- fighting system, water supply, rain water harvesting system, transformers, and electrical units, common area lighting and provision of services such as maintenance and upkeep of internal roads, complex boundary, pathways,lighting, water supply, STP, drainage, garbage disposal, horticulture and general watch and xxxx etc. within the complex.
(ii) The maintenance, upkeep, repairs, security etc. of the building including the common area of the building/apartment will be organized by the Promoter or its nominee until handing over of the building/tower/project to the Apartment Owners Association )“AOA”(/ Society. The Allottee(s) agrees and consents to the said arrangements. The allottee(s) shall make a one time payment of Corpus Fund as applicable to the Promoter. Apart from that the Allottee(s) shall pay monthly maintenance charges, which will be fixed by the Promoter or its nominee from time to time depending upon the maintenance cost. Any delay in making monthly maintenance payments shall make the Allottee(s) liable for interest @12% per annum.
(iii) Non-payment of any of the charges within the time specified shall also Dis-entitle the intending Allottee(s) to the enjoyment of common services. The Allottee(s) consents to this arrangement whether the buildings is transferred to other body corporate and shall continue till such time as the promoter terminates the arrangement.

APARTMENT / PROJECT: The Promoter/Developer shall be responsible to provide, maintain essential services in the Project till the taking over of the maintenance of the project by the association of Allottee upon the issuance of the completion certificate of the project. The cost of such maintenance start from the date of received OC/CC of the building or The Allottee taking over physical possession, (as mentioned in 7.1 above) whichever is earlier, is payable by The Allottee for the Apartment proportionately as per the rates to be calculated on per square feet basis (of the salable area of the Apartment) and/or in the manner as provided in this agreement and/or as may be so decided by the Co-Owner/Developer and/or the association of Allottee.

APARTMENT / PROJECT: The promoter shall be responsible to provide and maintain essential services in the Project till the taking over of the maintenance of the project by the association of the allottees upon the issuance of the occupancy certificate of the project. The cost of such maintenance has been included in the Total price of the Apartment. The time period and other terms and conditions pertaining to maintenance shall be incorporated in the Maintenance agreement to be executed by the Promoter or its nominated Maintenance agency which may be treated and read as a part of this agreement. The quantum of maintenance, club users fee and other charges as may be fixed by the agency shall be borne by the allottee and shall be payable as and when intimated by the Promoter prior to taking over Possession of the flat. In pursuance of the Maintenance agreement, the Promoter or its nominated Maintenance agency shall provide maintenance and operation of various services and facilities and equipment in the common area in the Complex and on assurance that Allottee(s) shall abide by the terms and conditions of this agreement and the rules and regulations as framed from time to time. The owner will pay advance maintenance as decided by the Promoter or its Nominated Maintenance agency.
