Corix and the City have also entered into that certain “Wastewater Facility Payment Contribution Agreement” setting forth the terms and conditions pursuant to which the City has agreed to advance funds to Corix as a contribution to the costs of the wastewater line improvements required to be constructed under the Wholesale Wastewater Services Agreement (the “Wastewater Line Improvements”) necessary to extend the City’s wastewater system and to receive wastewater from Corix’s retail customers.
