Costs and Revenues Related to an Affiliated Transmission Company. With respect to transmission facilities located in GMO certificated service territory that are constructed by a GMO transmission affiliate and are subject to regional cost allocation by SPP, GMO agrees that for ratemaking purposes in Missouri the costs allocated to GMO by SPP will be adjusted by an amount equal to the difference between: (i) GMO’s Missouri Network Integration Transmission Service allocated share of the annual revenue requirement for such facilities that would have resulted if GMO’s authorized return on equity (“XXX”) and capital structure had been applied and there had been no construction work in progress (“CWIP”) (if applicable) or other FERC Transmission Rate Incentives, including but not limited to Abandoned Plant Recovery, recovery on a current basis instead of capitalizing pre-commercial operations expenses and accelerated depreciation, applied to such facilities and (ii) GMO’s Missouri Network Integration Transmission Service allocated share of the annual FERC-authorized revenue requirement for such facilities. The ratemaking treatment agreed to in this paragraph will, unless otherwise agreed or ordered, end with the effective date of the Commission’s next Report and Order (after its Report and Order resolving this case) respecting GMO’s participation in SPP, another Regional Transmission Organization (“RTO”), or operation under an Independent Coordinator of Transmission (“ICT”). GMO agrees that the ratemaking treatment provisions in this paragraph shall in no way affect or limit the ratemaking treatment provisions in paragraphs II.A.1 and II.A.2 of the Non-unanimous Stipulation and Agreement filed on April 12, 2013 in File No. EA-2013-0098 and File No. EO-2012-0367.

If you use any of the Subscription Services or Software associated with Red Hat Enterprise Linux Developer Suite for Production Purposes, or use the Red Hat Enterprise Linux Software Subscription entitlement independently, you agree to purchase the applicable number of Units of the applicable Software Subscription. Red Hat does not provide Production Support or Development Support for Red Hat Enterprise Developer Suite.

  • Independent Contractor; No Partnership; No Agency; No Utility Services 15.1 Company and Developer shall be independent contractors. This Agreement shall not be interpreted or construed to create an association, joint venture, agency relationship, or partnership between the Parties or to impose any partnership obligation or partnership liability upon any Party. No Party shall have any right, power or authority to enter into any agreement or undertaking for, or act on behalf of, or to act as or be an agent or representative of, or to otherwise bind, the other Party.   • Red Hat Enterprise Linux Server Add-Ons Red Hat Enterprise Linux Server Subscriptions may be purchased with one or more add-on options (“Add-On(s)”). Add-Ons require a separate paid and active Software Subscriptions for each Unit that deploys, installs, uses or executes such Add-On. Each Unit of Add- Ons must match the Support Level (Standard and/or Premium), Unit of Measure and capacity as the underlying Red Hat Enterprise Linux Unit. Add-Ons are not supported on Red Hat Enterprise Linux Subscriptions with a Self-support service level except Smart Management Add-Ons. Restrooms and attendant facilities shall be provided as required in the orders and regulations of the State of Washington Department of Labor and Industries. A good faith effort will be made by the Employer to provide facilities for employees’ personal belongings.
