Common use of Costs of Mediation Clause in Contracts

Costs of Mediation. (a) Unless the Parties agree otherwise: (i) each Party is liable for their own costs of the mediation; and (ii) the Parties are jointly liable for the following costs of the mediation: (iii) the cost of the mediator; (iv) the cost of the room hire (if any); and (v) the cost of any additional input (including expert reports) agreed by both parties to be necessary to the conduction of the mediation.
