Costumes and Footwear. ‌ 1. OBT shall provide ARTISTS with all costume items including, but not limited to, wigs or hairpieces, hair coloring, shoes, body makeup, and any special makeup and accessories for character roles, and all costume accessories (i.e., jewelry, fans, and so forth) prior to Performances and rehearsals in which such items are required. The ARTIST will not be required to supply their own costumes for any Artist Activities. If OBT requests ARTIST to purchase their own items, OBT shall reimburse ARTIST a monetary equivalent. 2. OBT will reimburse, within two (2) weeks of presentation of receipts, each ARTIST that requires dance belts, up to seventy dollars ($70) per contract year for new dance belts, each ARTIST that requires tights up to fifty-two dollars ($52) per contract year for new tights and each ARTIST that requires socks up to twenty-four dollars ($24) per contract year for new socks. 3. OBT shall issue each Dancer new performance tights, thongs, trunks, bras, and dance belts (“undergarments”), as needed for the contract year. These undergarments will be issued before a Performance as needed and will be collected fifteen (15) minutes after the final curtain to be laundered. 4. All costumes and undergarments will be distributed in dressing areas both on tour or in City of Origination no later than half (1/2) hour call. ARTISTS shall notify the Wardrobe Supervisor of any missing items as soon as possible. 5. OBT will clean ARTISTS’ costumes at the beginning of each contract year, and prior to another ARTIST’s use. OBT agrees to launder all washable performance items (e.g., undergarments, unitards, socks, etc.) after each Performance. Further, OBT agrees to issue T-shirts, to be worn under costumes, as needed, and socks as necessitated by the costumes. The ARTISTS will never be required to wear unlaundered tights or washable performance items under any circumstances. Washable attached trunks of a costume must be laundered or hand-washed after each wearing when said costume is shared and upon request when costumes are not shared. 6. For any dry-clean only costume, OBT will spot-clean the groin/crotch and armpit areas after each wearing. 7. Wigs, beards, specialty make-up, accessories, hair pieces and/or costume jewelry that is required by OBT to be worn by the ARTIST in any dance piece shall be distributed no later than one-half (1/2) hour prior to the Performance or Dress Rehearsal.

  • Miscellaneous The Vendor acknowledges and agrees that continued participation in TIPS is subject to TIPS sole discretion and that any Vendor may be removed from the participation in the Program at any time with or without cause. Nothing in the Agreement or in any other communication between TIPS and the Vendor may be construed as a guarantee that TIPS or TIPS Members will submit any orders at any time. TIPS reserves the right to request additional proposals for items or services already on Agreement at any time.

  • Entire Agreement This DPA and the Service Agreement constitute the entire agreement of the Parties relating to the subject matter hereof and supersedes all prior communications, representations, or agreements, oral or written, by the Parties relating thereto. This DPA may be amended and the observance of any provision of this DPA may be waived (either generally or in any particular instance and either retroactively or prospectively) only with the signed written consent of both Parties. Neither failure nor delay on the part of any Party in exercising any right, power, or privilege hereunder shall operate as a waiver of such right, nor shall any single or partial exercise of any such right, power, or privilege preclude any further exercise thereof or the exercise of any other right, power, or privilege.

  • Definitions For purposes of this Agreement:

  • IN WITNESS WHEREOF the parties hereto have executed this Agreement as of the date first above written.

  • Severability Any provision of this Agreement that is prohibited or unenforceable in any jurisdiction shall, as to such jurisdiction, be ineffective to the extent of such prohibition or unenforceability without invalidating the remaining provisions hereof, and any such prohibition or unenforceability in any jurisdiction shall not invalidate or render unenforceable such provision in any other jurisdiction.

  • Termination In the event that either Party seeks to terminate this DPA, they may do so by mutual written consent so long as the Service Agreement has lapsed or has been terminated. Either party may terminate this DPA and any service agreement or contract if the other party breaches any terms of this DPA.

  • Governing Law This Agreement shall be governed by and construed in accordance with the laws of the State of New York.
