Common use of COUNCIL FUNDS Clause in Contracts

COUNCIL FUNDS. (1) The employer and the employee NBC Levy contribution shall be converted to a percentage–based contribution. (a) Every employer shall, on the pay day of each week and from the first pay day after this part of the Agreement comes into operation, deduct an amount of 0.21% of each employee’s wages per week, calculated at the qualified machinist’s rate of pay, up to a maximum of R3,04 per week for whom minimum wages are prescribed in this part of the Agreement: Provided that no deductions shall be made from the wage of an employee who has worked for less than 20 hours in the week in which the deductions fall due. (b) An employer shall, in respect of each contributor from whose wages deductions are made in terms of paragraph (a) above, contribute an amount of 0.23% of each employee’s wages per, calculated at the qualified machinist’s rate of pay, week up to a maximum of R3,27 per week. (3) The employer shall pay the total amounts so deducted, together with his contributions in terms of subclause (1) (b) above, to the Regional Secretary of the Regional Chamber, P O Box 1142, Woodstock, 7915, within 10 days of the end of the month in which the deductions fall due. (4) Where an employer has failed to deduct contributions from his employees he shall not be permitted to deduct arrear contributions, but shall make good these contributions himself. (5) Should any amount due in terms of subclause (1) not be received by the Regional Chamber by the 10th day after the date on which it is payable, the employer shall pay weekly interest on such amount or such lesser amounts as remain unpaid, calculated at the ruling prime overdraft rate plus two % per annum: Provided that the Regional Chamber shall be entitled in its absolute discretion to waive the payment of such interest or part thereof. At the discretion of the Regional Chamber, the interest may accrue to the general Funds of the Regional Chamber.

(3a) The employer shall pay the total amounts so deducted, together with his contributions in terms of subclause (1) (b) above, to the Regional Secretary of the Regional ChamberCouncil, P O Box 1142, Woodstock, 7915, within 10 seven days of from the end of the month in which the deductions fall duedue and such payment shall be accompanied by a completed copy of Annexures E and F, in the case of employers in the Magisterial Districts of Bloemfontein, Frankfort, Kroonstad, Xxxxxxxxx, Xxxxx and Vredefort. (4b) Where an employer has failed to deduct contributions from his employees the wages of employees, he shall not be permitted to deduct arrear contributions, contributions but shall make good these contributions himself. (5c) Should any amount due in terms of subclause (1) this clause not be received by the Regional Chamber Council by the 10th tenth day after the due date on which it is payable, the employer shall pay weekly interest on such amount or on such lesser amounts as remain unpaid, calculated at the ruling prime overdraft rate plus two % per cent per annum: Provided that the Regional Chamber Council shall be entitled in its absolute discretion to waive the payment of such interest or part thereof. At the discretion of the Regional ChamberCouncil, the interest may accrue to the general Funds funds of the Regional ChamberCouncil.

(4) Where an employer has failed to deduct contributions from his employees he shall not be permitted to deduct arrear contributions, but shall make good these contributions himself. (5) Should any amount due in terms of subclause (1) not be received by the Regional Chamber by the 10th day after the date on which it is payable, the employer shall pay weekly interest on such amount or such lesser amounts as remain unpaid, calculated at the ruling prime overdraft rate plus two % per annum: Provided that the Regional Chamber shall be entitled in its absolute discretion to waive the payment of such interest or part thereof. At the discretion of the Regional Chamber, the interest may accrue to the general Funds of the Regional Chamber.

COUNCIL FUNDS. (1) The employer and the employee NBC Levy contribution shall be converted to a percentage–based contribution. (a) Every employer shall, on the pay day of each week and from the first pay day after this part of the Agreement comes into operation, deduct an amount of 0.21% of each employee’s wages per week, calculated at the qualified machinist’s rate of pay, up to a maximum of R3,04 R3,28 per week for whom minimum wages are prescribed in this part of the Agreement: Provided that no deductions shall be made from the wage of an employee who has worked for less than 20 hours in the week in which the deductions fall due. (b) An employer shall, in respect of each contributor from whose wages deductions are made in terms of paragraph (a) above, contribute an amount of 0.23% of each employee’s wages per, calculated at the qualified machinist’s rate of pay, week up to a maximum of R3,27 R3,53 per week. (3) The employer shall pay the total amounts so deducted, together with his contributions in terms of subclause (1) (b) above, to the Regional Secretary of the Regional Chamber, P O Box 1142, Woodstock, 7915, within 10 days of the end of the month in which the deductions fall due. (4) Where an employer has failed to deduct contributions from his employees he shall not be permitted to deduct arrear contributions, but shall make good these contributions himself. (3) The employer shall pay the total amounts so deducted, together with his contributions in terms of subclause (1) (b) above, to the Regional Secretary of the Regional Chamber, P O Box 1142, Woodstock, 7915, within 10 days of the end of the month in which the deductions fall due. (4) Where an employer has failed to deduct contributions from his employees he shall not be permitted to deduct arrear contributions, but shall make good these contributions himself. COUNCIL FUNDS. (1) The employer and the employee NBC Levy contribution shall be converted to a percentage–– based contribution.. The funds of the Council, which shall be vested in and administered by the Council, shall be provided in the following manner: (a) Every employer shall, on the every pay day of each week and from the first pay day after of coming into operation of this part of the Agreement comes into operationAgreement, deduct an amount of 0.21equal to 0.28% of each employee’s employees wages per week, calculated at the qualified machinist’s machinist rate of pay, up to a maximum of R3,04 R1,82 per week for whom minimum wages are prescribed in this part of the Agreement: Provided that no deductions deduction shall be made from the wage wages of an employee who has worked for less than 20 hours in the week in which the deductions fall due: Provided further that no deductions shall be made from the holiday pay paid to each employee when the workplace closes in terms of clause 13 (1) of this part of the Agreement. (b) An employer shall, in respect of to each contributor from whose wages deductions are made in terms of paragraph (a) above, contribute an amount of 0.23equal to 0.40% of each employee’s employees wages perper week, calculated at the qualified machinist’s machinist rate of pay, week up to a maximum of R3,27 R1,97 per week. (3a) The employer shall pay the total amounts so deducted, together with his contributions in terms of subclause (1) (b) above, to the Regional Secretary of the Regional ChamberCouncil, P O Box 1142XX Xxx 0000, WoodstockXxxxxxxxx, 79150000, within 10 seven days of from the end of the month in which the deductions fall duedue and such payment shall be accompanied by a completed copy of Annexures E and F, in the case of employers in the Magisterial Districts of Bloemfontein, Frankfort, Kroonstad, Xxxxxxxxx, Xxxxx and Vredefort. (4b) Where an employer has failed to deduct contributions from his employees the wages of employees, he shall not be permitted to deduct arrear contributions, contributions but shall make good these contributions himself. (5c) Should any amount due in terms of subclause (1) this clause not be received by the Regional Chamber Council by the 10th tenth day after the due date on which it is payable, the employer shall pay weekly interest on such amount or on such lesser amounts as remain unpaid, calculated at the ruling prime overdraft rate plus two % per cent per annum: Provided that the Regional Chamber Council shall be entitled in its absolute discretion to waive the payment of such interest or part thereof. At the discretion of the Regional ChamberCouncil, the interest may accrue to the general Funds funds of the Regional ChamberCouncil.
