Common use of Court Ordered Requests for Call Detail Records and Other Subscriber Information Clause in Contracts

Court Ordered Requests for Call Detail Records and Other Subscriber Information. 7.1 To the extent technically feasible, BellSouth maintains call detail records for Mpower end users for limited time periods and can respond to subpoenas and court ordered requests for this information. BellSouth shall maintain such information for Mpower end users for the same length of time it maintains such information for its own end users. 7.2 Mpower agrees that BellSouth will respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to Mpower end users. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower agrees that in those cases where Mpower receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower end users, if Mpower does not have the requested information, Mpower will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 In all other instances, Mpower will provide Mpower end user and/or other customer information that is available to Mpower in response to subpoenas and court orders for their own customer records. When BellSouth receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower end users, BellSouth will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpower.

Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 7.2 Xxxxxxxx agrees that in those cases where Mpower Xxxxxxxx receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower Pinnacle end users, if Mpower does not have the requested information, Mpower Pinnacle will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 7.3 In all other instancescases where the timing of the response to the law enforcement agency prohibits Pinnacle from having the subpoena or court ordered request redirected to BellSouth by the law enforcement agency, Mpower Pinnacle will furnish the official request to BellSouth for providing the call detail information. BellSouth will provide Mpower the call detail records to Pinnacle and xxxx Xxxxxxxx for the information. Xxxxxxxx agrees to reimburse BellSouth for the call detail information provided. 7.4 Pinnacle will provide Pinnacle end user and/or other customer information that is available to Mpower Pinnacle in response to subpoenas and court orders for their own customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging for Pinnacle end user and/or other customer information to Mpower end users, BellSouth will advise Pinnacle for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower AT&T telecommunications services for resale or providing to Mpower AT&T the local switching function, then Mpower AT&T agrees that in those cases where Mpower AT&T receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower AT&T end users, if Mpower AT&T does not have the requested information, Mpower AT&T will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 In all other instances, Mpower Access One will provide Mpower Access One end user and/or other customer information that is available to Mpower Access One in response to subpoenas and court orders for their own customer records. When BellSouth receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower AT&T end users, BellSouth will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpower.AT&T.

Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower Xxxxxxx agrees that in those cases where Mpower Xxxxxxx receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower Knology end users, if Mpower does not have the requested information, Mpower Knology will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 In all other instancescases where the timing of the response to the law enforcement agency prohibits Knology from having the subpoena or court ordered request redirected to BellSouth by the law enforcement agency, Mpower Knology will furnish the official request to BellSouth for providing the call detail information. XxxxXxxxx will provide Mpower the call detail records to Knology and xxxx Xxxxxxx for the information. Xxxxxxx agrees to reimburse XxxxXxxxx for the call detail information provided. 7.5 Knology will provide Knology end user and/or other customer information that is available to Mpower Knology in response to subpoenas and court orders for their own Knology customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging for Knology end user and/or other customer information to Mpower end users, BellSouth will advise Knology for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 7.2 ITC^DeltaCom agrees that in those cases where Mpower ITC^DeltaCom receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower ITC^DeltaCom end users, if Mpower does not have the requested information, Mpower ITC^DeltaCom will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 7.3 In all other instancescases where the timing of the response to the law enforcement agency prohibits ITC^DeltaCom from having the subpoena or court ordered request redirected to BellSouth by the law enforcement agency, Mpower ITC^DeltaCom will furnish the official request to BellSouth for providing the call detail information. BellSouth will provide Mpower the call detail records to ITC^DeltaCom and xxxx ITC^DeltaCom for the information. ITC^DeltaCom agrees to reimburse BellSouth for the call detail information provided. 7.4 ITC^DeltaCom will provide ITC^DeltaCom end user and/or other customer information that is available to Mpower ITC^DeltaCom in response to subpoenas and court orders for their own customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging ITC^DeltaCom end user and/or other customer information to Mpower end users, BellSouth will advise ITC^DeltaCom for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 7.2 BlueStar agrees that in those cases where Mpower BlueStar receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower BlueStar end users, if Mpower does not have the requested information, Mpower BlueStar will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 7.3 In all other instancescases where the timing of the response to the law enforcement agency prohibits BlueStar from having the subpoena or court ordered request redirected to BellSouth by the law enforcement agency, Mpower BlueStar will furnish the official request to BellSouth for providing the call detail information. BellSouth will provide Mpower the call detail records to BlueStar and bill BlueStar for the information. XxxxXxxx agrees to reimburse BellSouth for the call detail information provided. 7.4 BlueStar will provide BlueStar end user and/or other customer information that is available to Mpower BlueStar in response to subpoenas and court orders for their own customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging for BlueStar end user and/or other customer information to Mpower end users, BellSouth will advise BlueStar for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 24.14.3 Where BellSouth is providing to Mpower TCG telecommunications services for resale or providing to Mpower TCG the local switching function, then Mpower TCG agrees that in those cases where Mpower TCG receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower TCG end users, if Mpower TCG does not have the requested information, Mpower TCG will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 24.14.4 In all other instances, Mpower TCG will provide Mpower TCG end user and/or other customer information that is available to Mpower TCG in response to subpoenas and court orders for their own customer end user records. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower PointeCom telecommunications services for resale or providing to Mpower PointeCom the local switching function, then Mpower PointeCom agrees that in those cases where Mpower PointeCom receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower PointeCom end users, if Mpower PointeCom does not have the requested information, Mpower PointeCom will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 In all other instances, Mpower MPC will provide Mpower MPC end user and/or other customer information that is available to Mpower MPC in response to subpoenas and court orders for their own customer records. Billing for such requests will be generated by BellSouth BellSouthAT&T and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 8.2 Sprint agrees that in those cases where Mpower Xxxxxx receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower Sprint end users, if Mpower does not have the requested information, Mpower Sprint will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing BellSouthAT&T. Billing for call detail information will be generated by BellSouth BellSouthAT&T and directed to the law enforcement agency initiating the request. 7.4 8.3 In all other instancescases where the timing of the response to the law enforcement agency prohibits Sprint from having the subpoena or court ordered request redirected to BellSouthAT&T by the law enforcement agency, Mpower Sprint will furnish the official request to BellSouthAT&T for providing the call detail information. XxxxXxxxxXX&X will provide Mpower the call detail records to Sprint and bill Sprint for the information. Xxxxxx agrees to reimburse XxxxXxxxxXX&X for the call detail information provided. 8.4 Sprint will provide Sprint end user and/or other customer information that is available to Mpower Sprint in response to subpoenas and court orders for their own customer records. When BellSouth receives BellSouthAT&T will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging for Sprint end user and/or other customer information to Mpower end users, BellSouth will advise Sprint for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 7.2 InterCept agrees that in those cases where Mpower InterCept receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower InterCept end users, if Mpower does not have the requested information, Mpower InterCept will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. InterCept agrees to reimburse XxxxXxxxx for the call detail information provided. 7.4 InterCept will provide InterCept end user and/or other customer information that is available to Mpower InterCept in response to subpoenas and court orders for their own customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging for InterCept end user and/or other customer information to Mpower end users, BellSouth will advise InterCept for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower Z-Tel telecommunications services for resale or providing to Mpower Z-Tel the local switching function, then Mpower Z-Tel agrees that in those cases where Mpower Z-Tel receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower Z-Tel end users, if Mpower Z-Tel does not have the requested information, Mpower Z-Tel will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 In all other instances, Mpower Z-Tel will provide Mpower Z-Tel end user and/or other customer information that is available to Mpower Z-Tel in response to subpoenas and court orders for their own customer records. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 24.14.3 Where BellSouth is providing to Mpower AT&T telecommunications services for resale or providing to Mpower AT&T the local switching function, then Mpower AT&T agrees that in those cases where Mpower AT&T receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower AT&T end users, if Mpower AT&T does not have the requested information, Mpower AT&T will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 24.14.4 In all other instances, Mpower AT&T will provide Mpower AT&T end user and/or other customer information that is available to Mpower AT&T in response to subpoenas and court orders for their own customer end user records. When BellSouth receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower AT&T end users, BellSouth will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpower.AT&T.

Court Ordered Requests for Call Detail Records and Other Subscriber Information. 7.1 To the extent technically feasible, where BellSouth provides resale or local switching to Xxxxx 0, XxxxXxxxx maintains call detail records for Mpower Level 3 end users for limited time periods and can respond to subpoenas and court ordered requests for this information. BellSouth shall maintain such information for Mpower Level 3 end users for the same length of time it maintains such information for its own end users. 7.2 Mpower agrees that 7.1 BellSouth will respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to Mpower Level 3 end usersusers and where BellSouth maintains call detail records responsive to the law enforcement agency subpoena or court ordered request. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. If BellSouth does not maintain the call detail records, BellSouth will direct the law enforcement agency initiating the request to Level 3. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 7.2 Level 3 agrees that in those cases where Mpower Level 3 receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower Level 3 end users, if Mpower Xxxxx 0 does not have maintain the requested informationcall detail records responsive to such requests, Mpower Xxxxx 0 will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 In all other instances, Mpower 7.3 Level 3 will provide Mpower Level 3 end user and/or other customer information that is available to Mpower Level 3 in response to subpoenas and court orders for their own customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging for Level 3 end user and/or other customer information to Mpower end users, BellSouth will advise Level 3 for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Court Ordered Requests for Call Detail Records and Other Subscriber Information. 7.1 To the extent technically feasible, BellSouth maintains call detail records for Mpower BTI end users for limited time periods and can respond to subpoenas and court ordered requests for this information. BellSouth shall maintain such information for Mpower BTI end users for the same length of time it maintains such information for its own end users. 7.2 Mpower 7.1 BTI agrees that BellSouth will respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to Mpower BTI end users. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the requestbona fide requesting party. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 7.2 BTI agrees that in those cases where Mpower BTI receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower BTI end users, if Mpower does not have the requested information, Mpower BTI will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 7.3 In all other instancescases where the timing of the response to the law enforcement agency prohibits BTI from having the subpoena or court ordered request redirected to BellSouth by the law enforcement agency, Mpower BTI will furnish the official request to BellSouth for providing the call detail information. BellSouth will provide Mpower the call detail records to BTI and xxxx BTI a reasonable rate for the information. BTI agrees to reimburse BellSouth for the call detail information provided. 7.4 BTI will provide BTI end user and/or other customer information that is available to Mpower BTI in response to subpoenas and court orders for their own customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging for BTI end user and/or other customer information to Mpower end users, BellSouth will advise BTI for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Court Ordered Requests for Call Detail Records and Other Subscriber Information. 7.1 To the extent technically feasible, BellSouth maintains call detail records for Mpower Pyramid end users for limited time periods and can respond to subpoenas and court ordered requests for this information. BellSouth shall maintain such information for Mpower Pyramid end users for the same length of time it maintains such information for its own end users. 7.2 Mpower Xxxxxxx agrees that BellSouth will respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to Mpower Pyramid end users. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower AT&T telecommunications services for resale or providing to Mpower AT&T the local switching function, then Mpower AT&T agrees that in those cases where Mpower AT&T receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower AT&T end users, if Mpower AT&T does not have the requested information, Mpower AT&T will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 In all other instances, Mpower Pyramid will provide Mpower Pyramid end user and/or other customer information that is available to Mpower Pyramid in response to subpoenas and court orders for their own customer records. When BellSouth receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower AT&T end users, BellSouth will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpower.AT&T.

Court Ordered Requests for Call Detail Records and Other Subscriber Information. 7.1 To the extent technically feasible, BellSouth maintains call detail records for Mpower Comm South end users for limited time periods and can respond to subpoenas and court ordered requests for this information. BellSouth shall maintain such information for Mpower Comm South end users for the same length of time it maintains such information for its own end users. 7.2 Mpower 7.1 Comm South agrees that BellSouth XxxxXxxxx will respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to Mpower Comm South end users. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 7.2 Comm South agrees that in those cases where Mpower Comm South receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower Comm South end users, if Mpower does not have the requested information, Mpower Comm South will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 7.3 In all other instancescases where the timing of the response to the law enforcement agency prohibits Comm South from having the subpoena or court ordered request redirected to BellSouth by the law enforcement agency, Mpower Comm South will furnish the official request to BellSouth for providing the call detail information. BellSouth will provide Mpower the call detail records to Comm South and bill Comm South for the information. Comm Xxxxx agrees to reimburse BellSouth for the call detail information provided. 7.4 Comm South will provide Comm South end user and/or other customer information that is available to Mpower Comm South in response to subpoenas and court orders for their own customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging for Comm South end user and/or other customer information to Mpower end users, BellSouth will advise Comm South for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Court Ordered Requests for Call Detail Records and Other Subscriber Information. 7.1 To the extent technically feasible, BellSouth maintains call detail records for Mpower TLX end users for limited time periods and can respond to subpoenas and court ordered requests for this information. BellSouth shall maintain such information for Mpower TLX end users for the same length of time it maintains such information for its own end users. 7.2 Mpower TLX agrees that BellSouth XxxxXxxxx will respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to Mpower TLX end users. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower TLX telecommunications services for resale or providing to Mpower TLX the local switching function, then Mpower TLX agrees that in those cases where Mpower TLX receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower TLX end users, if Mpower TLX does not have the requested information, Mpower TLX will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 In all other instances, Mpower TLX will provide Mpower TLX end user and/or other customer information that is available to Mpower TLX in response to subpoenas and court orders for their own customer records. When BellSouth receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower TLX end users, BellSouth will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to MpowerTLX.

Court Ordered Requests for Call Detail Records and Other Subscriber Information. 7.1 To the extent technically feasible, BellSouth maintains call detail records for Mpower Express Title end users for limited time periods and can respond to subpoenas and court ordered requests for this information. BellSouth shall maintain such information for Mpower Express Title end users for the same length of time it maintains such information for its own end users. 7.2 Mpower 7.1 Express Title agrees that BellSouth will respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to Mpower Express Title end users. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 7.2 Express Title agrees that in those cases where Mpower Express Title receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower Express Title end users, if Mpower does not have the requested information, Mpower Express Title will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 7.3 In all other instancescases where the timing of the response to the law enforcement agency prohibits Express Title from having the subpoena or court ordered request redirected to BellSouth by the law enforcement agency, Mpower Express Title will furnish the official request to BellSouth for providing the call detail information. BellSouth will provide Mpower the call detail records to Express Title and xxxx Express Title for the information. Express Title agrees to reimburse BellSouth for the call detail information provided. 7.4 Express Title will provide Express Title end user and/or other customer information that is available to Mpower Express Title in response to subpoenas and court orders for their own customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging for Express Title end user and/or other customer information to Mpower end users, BellSouth will advise Express Title for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Court Ordered Requests for Call Detail Records and Other Subscriber Information. 7.1 To the extent technically feasible, BellSouth maintains call detail records for Mpower NewSouth end users for limited time periods and can respond to subpoenas and court ordered requests for this information. BellSouth shall maintain such information for Mpower NewSouth end users for the same length of time it maintains such information for its own end users. 7.2 Mpower 7.1 NewSouth agrees that BellSouth XxxxXxxxx will respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to Mpower NewSouth end users. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 7.2 NewSouth agrees that in those cases where Mpower XxxXxxxx receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower NewSouth end users, if Mpower does not have the requested information, Mpower NewSouth will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 In cases where the timing of the response to the law enforcement agency prohibits NewSouth from having the subpoena or court ordered request redirected to 7.4 In all other instances, Mpower NewSouth will provide Mpower NewSouth end user and/or other customer information that is available to Mpower NewSouth in response to subpoenas and court orders for their own customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging NewSouth end user and/or other customer information to Mpower end users, BellSouth will advise NewSouth for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Court Ordered Requests for Call Detail Records and Other Subscriber Information. 7.1 To the extent technically feasible, BellSouth maintains call detail records for Mpower ITC^DeltaCom end users for limited time periods and can respond to subpoenas and court ordered requests for this information. BellSouth shall maintain such information for Mpower ITC^DeltaCom end users for the same length of time it maintains such information for its own end users. 7.2 Mpower 8.1 ITC^DeltaCom agrees that BellSouth will respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to Mpower ITC^DeltaCom end users. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 8.2 ITC^DeltaCom agrees that in those cases where Mpower ITC^DeltaCom receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower ITC^DeltaCom end users, if Mpower does not have the requested information, Mpower ITC^DeltaCom will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 8.3 In all other instancescases where the timing of the response to the law enforcement agency prohibits ITC^DeltaCom from having the subpoena or court ordered request redirected to BellSouth by the law enforcement agency, Mpower ITC^DeltaCom will furnish the official request to BellSouth for providing the call detail information. BellSouth will provide Mpower the call detail records to ITC^DeltaCom and bill ITC^DeltaCom for the information. ITC^DeltaCom agrees to reimburse BellSouth for the call detail information provided. 8.4 ITC^DeltaCom will provide ITC^DeltaCom end user and/or other customer information that is available to Mpower ITC^DeltaCom in response to subpoenas and court orders for their own customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging ITC^DeltaCom end user and/or other customer information to Mpower end users, BellSouth will advise ITC^DeltaCom for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Court Ordered Requests for Call Detail Records and Other Subscriber Information. 7.1 To the extent technically feasible, BellSouth maintains call detail records for Mpower Birch end users for limited time periods and can respond to subpoenas and court ordered requests for this information. BellSouth shall maintain such information for Mpower Birch end users for the same length of time it maintains such information for its own end users. 7.2 Mpower Xxxxx agrees that BellSouth XxxxXxxxx will respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to Mpower Birch end users. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower Birch telecommunications services for resale or providing to Mpower Birch the local switching function, then Mpower Xxxxx agrees that in those cases where Mpower Xxxxx receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower Birch end users, if Mpower Xxxxx does not have the requested information, Mpower Xxxxx will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 In all other instances, Mpower Birch will provide Mpower Birch end user and/or other customer information that is available to Mpower Birch in response to subpoenas and court orders for their own customer records. When BellSouth receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower Birch end users, BellSouth will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to MpowerXxxxx.

Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 24.14.3 Where BellSouth is providing to Mpower AT&T telecommunications services for resale or providing to Mpower AT&T the local switching function, then Mpower AT&T agrees that in those cases where Mpower AT&T receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower AT&T end users, if Mpower AT&T does not have the requested information, Mpower AT&T will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 24.14.4 In all other instances, Mpower AT&T will provide Mpower AT&T end user and/or other customer information that is available to Mpower AT&T in response to subpoenas and court orders for their own customer end user records. When BellSouth receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower AT&T end users, BellSouth XxxxXxxxx will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpower.AT&T.

Court Ordered Requests for Call Detail Records and Other Subscriber Information. 7.1 To the extent technically feasible, BellSouth maintains call detail records for Mpower Oltronics end users for limited time periods and can respond to subpoenas and court ordered requests for this information. BellSouth shall maintain such information for Mpower Oltronics end users for the same length of time it maintains such information for its own end users. 7.2 Mpower 7.1 Xxxxxxxxx agrees that BellSouth XxxxXxxxx will respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to Mpower Oltronics end users. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 7.2 Xxxxxxxxx agrees that in those cases where Mpower Xxxxxxxxx receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower Oltronics end users, if Mpower does not have the requested information, Mpower Oltronics will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 7.3 In all other instancescases where the timing of the response to the law enforcement agency prohibits Oltronics from having the subpoena or court ordered request redirected to BellSouth by the law enforcement agency, Mpower Oltronics will furnish the official request to BellSouth for providing the call detail information. XxxxXxxxx will provide Mpower the call detail records to Oltronics and xxxx Xxxxxxxxx for the information. Xxxxxxxxx agrees to reimburse XxxxXxxxx for the call detail information provided. 7.4 Oltronics will provide Oltronics end user and/or other customer information that is available to Mpower Oltronics in response to subpoenas and court orders for their own customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging for Oltronics end user and/or other customer information to Mpower end users, BellSouth will advise Oltronics for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Court Ordered Requests for Call Detail Records and Other Subscriber Information. 7.1 To the extent technically feasible, BellSouth maintains call detail records for Mpower Intermedia end users for limited time periods and can respond to subpoenas and court ordered requests for this information. BellSouth shall maintain such information for Mpower Intermedia end users for the same length of time it maintains such information for its own end users. 7.2 Mpower 6.1 Intermedia agrees that BellSouth will respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to Mpower Intermedia end users. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 6.2 Intermedia agrees that in those cases where Mpower Intermedia receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower Intermedia end users, if Mpower does not have the requested information, Mpower Intermedia will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 6.3 In all other instancescases where the timing of the response to the law enforcement agency prohibits Intermedia from having the subpoena or court ordered request redirected to BellSouth by the law enforcement agency, Mpower Intermedia will furnish the official request to BellSouth for providing the call detail information. BellSouth will provide Mpower the call detail records to Intermedia and xxxx Intermedia for the information. Intermedia agrees to reimburse BellSouth for the call detail information provided. 6.4 Intermedia will provide Intermedia end user and/or other customer information that is available to Mpower Intermedia in response to subpoenas and court orders for their own customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging for Intermedia end user and/or other customer information to Mpower end users, BellSouth will advise Intermedia for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Court Ordered Requests for Call Detail Records and Other Subscriber Information. 7.1 To the extent technically feasible, BellSouth maintains call detail records for Mpower Lightyear end users for limited time periods and can respond to subpoenas and court ordered requests for this information. BellSouth shall maintain such information for Mpower Lightyear end users for the same length of time it maintains such information for its own end users. 7.2 Mpower Lightyear agrees that BellSouth XxxxXxxxx will respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to Mpower Lightyear end users. Where the request has been forwarded to BellSouth, billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 In all other instances, Mpower Lightyear will provide Mpower Lightyear end user and/or other customer information that is available to Mpower Lightyear in response to subpoenas and court orders for their own customer records. When BellSouth receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower Lightyear end users, BellSouth will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to MpowerLightyear.

Court Ordered Requests for Call Detail Records and Other Subscriber Information. 7.1 To the extent technically feasible, BellSouth maintains call detail records for Mpower Money To Go end users for limited time periods and can respond to subpoenas and court ordered requests for this information. BellSouth shall maintain such information for Mpower Money To Go end users for the same length of time it maintains such information for its own end users. 7.2 Mpower Money To Go agrees that BellSouth XxxxXxxxx will respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to Mpower Money To Go end users. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower Money To Go telecommunications services for resale or providing to Mpower Money To Go the local switching function, then Mpower Money To Go agrees that in those cases where Mpower Money To Go receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower Money To Go end users, if Mpower Money To Go does not have the requested information, Mpower Money To Go will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 In all other instances, Mpower Money To Go will provide Mpower Money To Go end user and/or other customer information that is available to Mpower Money To Go in response to subpoenas and court orders for their own customer records. When BellSouth receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower Money To Go end users, BellSouth will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to MpowerMoney To Go.

Court Ordered Requests for Call Detail Records and Other Subscriber Information. 7.1 To the extent technically feasible, BellSouth maintains call detail records for Mpower Accutel end users for limited time periods and can respond to subpoenas and court ordered requests for this information. BellSouth shall maintain such information for Mpower Accutel end users for the same length of time it maintains such information for its own end users. 7.2 Mpower Accutel agrees that BellSouth XxxxXxxxx will respond to subpoenas and court ordered requests delivered directly to BellSouth XxxxXxxxx for the purpose of providing call detail records when the targeted telephone numbers belong to Mpower Accutel end users. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower Accutel telecommunications services for resale or providing to Mpower Accutel the local switching function, then Mpower Accutel agrees that in those cases where Mpower Accutel receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower Accutel end users, if Mpower Accutel does not have the requested information, Mpower Accutel will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 In all other instances, Mpower Accutel will provide Mpower Accutel end user and/or other customer information that is available to Mpower Accutel in response to subpoenas and court orders for their own customer records. When BellSouth receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower Accutel end users, BellSouth will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to MpowerAccutel.

Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 7.2 Xxxx and Associates agrees that in those cases where Mpower Xxxx and Associates receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower Xxxx and Associates end users, if Mpower does not have the requested information, Mpower Xxxx and Associates will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouthXxxxXxxxx. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 7.3 In all other instancescases where the timing of the response to the law enforcement agency prohibits Xxxx and Associates from having the subpoena or court ordered request redirected to BellSouth by the law enforcement agency, Mpower Xxxx and Associates will furnish the official request to BellSouth for providing the call detail information. BellSouth will provide Mpower the call detail records to Xxxx and Associates and xxxx Xxxx and Associates for the information. Xxxx and Associates agrees to reimburse BellSouth for the call detail information provided. 7.4 Jake and Associates will provide Xxxx and Associates end user and/or other customer information that is available to Mpower Jake and Associates in response to subpoenas and court orders for their own customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging Xxxx and Associates end user and/or other customer information to Mpower end users, BellSouth will advise Xxxx and Associates for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Court Ordered Requests for Call Detail Records and Other Subscriber Information. 7.1 To the extent technically feasible, BellSouth maintains call detail records for Mpower Unity end users for limited time periods and can respond to subpoenas and court ordered requests for this information. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 7.2 Unity agrees that in those cases where Mpower Xxxxx receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower Unity end users, if Mpower does not have the requested information, Mpower Unity will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 7.3 In all other instancescases where the timing of the response to the law enforcement agency prohibits Unity from having the subpoena or court ordered request redirected to BellSouth by the law enforcement agency, Mpower Unity will furnish the official request to BellSouth for providing the call detail information. XxxxXxxxx will provide Mpower the call detail records to Unity and bill Unity for the information. Xxxxx agrees to reimburse XxxxXxxxx for the call detail information provided. 7.4 Unity will provide Unity end user and/or other customer information that is available to Mpower Unity in response to subpoenas and court orders for their own customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging for Unity end user and/or other customer information to Mpower end users, BellSouth will advise Unity for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower USA Digital telecommunications services for resale or providing to Mpower USA Digital the local switching function, then Mpower USA Digital agrees that in those cases where Mpower USA Digital receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower USA Digital end users, if Mpower USA Digital does not have the requested information, Mpower USA Digital will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 In all other instances, Mpower USA Digital will provide Mpower USA Digital end user and/or other customer information that is available to Mpower USA Digital in response to subpoenas and court orders for their own customer records. When BellSouth receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower USA Digital end users, BellSouth will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to MpowerUSA Digital.

Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 7.2 Pathnet agrees that in those cases where Mpower Xxxxxxx receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower Pathnet end users, if Mpower does not have the requested information, Mpower Pathnet will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 7.3 In all other instancescases where the timing of the response to the law enforcement agency prohibits Pathnet from having the subpoena or court ordered request redirected to BellSouth by the law enforcement agency, Mpower Pathnet will furnish the official request to BellSouth for providing the call detail information. BellSouth will provide Mpower the call detail records to Pathnet and bill Pathnet for the information. Xxxxxxx agrees to reimburse BellSouth for the call detail information provided. 7.4 Pathnet will provide Pathnet end user and/or other customer information that is available to Mpower Pathnet in response to subpoenas and court orders for their own customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging for Pathnet end user and/or other customer information to Mpower end users, BellSouth will advise Pathnet for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 24.15.3 Where BellSouth is providing to Mpower AT&T telecommunications services for resale or providing to Mpower the local switching function, then Mpower AT&T agrees that in those cases where Mpower AT&T receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower AT&T end users, if Mpower AT&T does not have the requested information, Mpower AT&T will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 24.15.4 In all other instances, Mpower AT&T will provide Mpower AT&T end user and/or other customer information that is available to Mpower AT&T in response to subpoenas and court orders for their own customer end user records. When BellSouth receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower AT&T end users, BellSouth will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpower.AT&T.

Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 7.2 Davco agrees that in those cases where Mpower Xxxxx receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower Davco end users, if Mpower does not have the requested information, Mpower Davco will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 7.3 In all other instancescases where the timing of the response to the law enforcement agency prohibits Davco from having the subpoena or court ordered request redirected to BellSouth by the law enforcement agency, Mpower Davco will furnish the official request to BellSouth for providing the call detail information. Xxxxx agrees to reimburse XxxxXxxxx for the call detail information provided. 7.4 Davco will provide Davco end user and/or other customer information that is available to Mpower Davco in response to subpoenas and court orders for their own customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging for Davco end user and/or other customer information to Mpower end users, BellSouth will advise Davco for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Court Ordered Requests for Call Detail Records and Other Subscriber Information. 7.1 To the extent technically feasible, BellSouth maintains call detail records for Mpower Centennial end users for limited time periods and can respond to subpoenas and court ordered requests for this information. BellSouth shall maintain such information for Mpower Centennial end users for the same length of time it maintains such information for its own end users. 7.2 Mpower Centennial agrees that BellSouth XxxxXxxxx will respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to Mpower Centennial end users. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower Centennial telecommunications services for resale or providing to Mpower Centennial the local switching function, then Mpower Centennial agrees that in those cases where Mpower Centennial receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower Centennial end users, if Mpower Centennial does not have the requested information, Mpower Centennial will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 In all other instances, Mpower Centennial will provide Mpower Centennial end user and/or other customer information that is available to Mpower Centennial in response to subpoenas and court orders for their own customer records. When BellSouth receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower Centennial end users, BellSouth will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to MpowerCentennial.

Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 7.2 Community agrees that in those cases where Mpower Community receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower Community end users, if Mpower does not have the requested information, Mpower Community will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 7.3 In all other instancescases where the timing of the response to the law enforcement agency prohibits Community from having the subpoena or court ordered request redirected to BellSouth by the law enforcement agency, Mpower Community will furnish the official request to BellSouth for providing the call detail information. XxxxXxxxx will provide Mpower the call detail records to Community and bill Community for the information. Community agrees to reimburse XxxxXxxxx for the call detail information provided. 7.4 Community will provide Community end user and/or other customer information that is available to Mpower Community in response to subpoenas and court orders for their own customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging for Community end user and/or other customer information to Mpower end users, BellSouth will advise Community for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Where the request has been forwarded to BellSouth, billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 In all other instances, Mpower Birch will provide Mpower Birch end user and/or other customer information that is available to Mpower Birch in response to subpoenas and court orders for their own customer records. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower Globe agrees that in those cases where Mpower Globe receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower Globe end users, if Mpower does not have the requested information, Mpower Globe will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 In all other instancescases where the timing of the response to the law enforcement agency prohibits Globe from having the subpoena or court ordered request redirected to BellSouth by the law enforcement agency, Mpower Globe will furnish the official request to BellSouth for providing the call detail information. XxxxXxxxx will provide Mpower the call detail records to Globe and bill Globe for the information. Globe agrees to reimburse XxxxXxxxx for the call detail information provided. 7.5 Globe will provide Globe end user and/or other customer information that is available to Mpower Globe in response to subpoenas and court orders for their own Globe customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging for Globe end user and/or other customer information to Mpower end users, BellSouth will advise Globe for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Court Ordered Requests for Call Detail Records and Other Subscriber Information. 7.1 To the extent technically feasible, BellSouth maintains and shall maintain call detail records for Mpower Knology end users for limited time periods and can may respond to subpoenas and court ordered requests for this information. Knology agrees to reimburse BellSouth for the call detail information provided. 7.5 Knology will provide Knology end user and/or other customer information that is available to Mpower Knology in response to subpoenas and court orders for their own Knology customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging for Knology end user and/or other customer information to Mpower end users, BellSouth will advise Knology for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 7.2 Xxxxxxx agrees that in those cases where Mpower Xxxxxxx receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower Colmena end users, if Mpower does not have the requested information, Mpower Xxxxxxx will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 7.3 In all other instancescases where the timing of the response to the law enforcement agency prohibits Xxxxxxx from having the subpoena or court ordered request redirected to BellSouth by the law enforcement agency, Mpower Xxxxxxx will furnish the official request to BellSouth for providing the call detail information. BellSouth will provide Mpower the call detail records to Colmena and xxxx Xxxxxxx for the information. Xxxxxxx agrees to reimburse XxxxXxxxx for the call detail information provided. 7.4 Colmena will provide Colmena end user and/or other customer information that is available to Mpower Colmena in response to subpoenas and court orders for their own customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging for Colmena end user and/or other customer information to Mpower end users, BellSouth will advise Colmena for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Court Ordered Requests for Call Detail Records and Other Subscriber Information. 7.1 To the extent technically feasibleWhere BellSouth provides resold services or local switching, BellSouth maintains and shall maintain call detail records for Mpower Knology end users for limited time periods and can may respond to subpoenas and court ordered requests for this information. BellSouth shall maintain such information for Mpower Knology end users for the same length of time it maintains such information for its own end users. 7.2 Mpower agrees that BellSouth will BellSouth, to the extent permitted by law, may respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to Mpower Knology end users. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 In all other instancescases where the timing of the response to the law enforcement agency prohibits Knology from having the subpoena or court ordered request redirected to BellSouth by the law enforcement agency, Mpower Knology will furnish the official request to BellSouth for providing the call detail information. BellSouth will provide Mpower the call detail records to Knology and xxxx Knology for the information. Knology agrees to reimburse BellSouth for the call detail information provided. 7.5 Knology will provide Knology end user and/or other customer information that is available to Mpower Knology in response to subpoenas and court orders for their own Knology customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging for Knology end user and/or other customer information to Mpower end users, BellSouth will advise Knology for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 7.2 MET Communications agrees that in those cases where Mpower MET Communications receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower MET Communications end users, if Mpower does not have the requested information, Mpower MET Communications will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouthXxxxXxxxx. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 7.3 In all other instancescases where the timing of the response to the law enforcement agency prohibits MET Communications from having the subpoena or court ordered request redirected to BellSouth by the law enforcement agency, Mpower MET Communications will furnish the official request to BellSouth for providing the call detail information. XxxxXxxxx will provide Mpower the call detail records to MET Communications and bill MET Communications for the information. MET Communications agrees to reimburse XxxxXxxxx for the call detail information provided. 7.4 MET Communications will provide MET Communications end user and/or other customer information that is available to Mpower MET Communications in response to subpoenas and court orders for their own customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging for MET Communications end user and/or other customer information to Mpower end users, BellSouth will advise MET Communications for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower Xxxxxxx telecommunications services for resale or providing to Mpower Xxxxxxx the local switching function, then Mpower Xxxxxxx agrees that in those cases where Mpower Xxxxxxx receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower Xxxxxxx end users, if Mpower Xxxxxxx does not have the requested information, Mpower Xxxxxxx will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 In all other instances, Mpower Xxxxxxx will provide Mpower Xxxxxxx end user and/or other customer information that is available to Mpower Xxxxxxx in response to subpoenas and court orders for their own customer records. When BellSouth receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower Xxxxxxx end users, BellSouth will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to MpowerXxxxxxx.

Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 8.2 Sprint agrees that in those cases where Mpower Sprint receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower Sprint end users, if Mpower does not have the requested information, Mpower Sprint will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 8.3 In all other instancescases where the timing of the response to the law enforcement agency prohibits Sprint from having the subpoena or court ordered request redirected to BellSouth by the law enforcement agency, Mpower Sprint will furnish the official request to BellSouth for providing the call detail information. BellSouth will provide Mpower the call detail records to Sprint and xxxx Sprint for the information. Sprint agrees to reimburse BellSouth for the call detail information provided. 8.4 Sprint will provide Sprint end user and/or other customer information that is available to Mpower Sprint in response to subpoenas and court orders for their own customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging for Sprint end user and/or other customer information to Mpower end users, BellSouth will advise Sprint for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Court Ordered Requests for Call Detail Records and Other Subscriber Information. 7.1 To the extent technically feasible, BellSouth maintains call detail records for Mpower ECI end users for limited time periods and can respond to subpoenas and court ordered requests for this information. BellSouth shall maintain such information for Mpower ECI end users for the same length of time it maintains such information for its own end users. 7.2 Mpower ECI agrees that BellSouth XxxxXxxxx will respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to Mpower ECI end users. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower ECI telecommunications services for resale or providing to Mpower ECI the local switching function, then Mpower ECI agrees that in those cases where Mpower ECI receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower ECI end users, if Mpower ECI does not have the requested information, Mpower ECI will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 In all other instances, Mpower ECI will provide Mpower ECI end user and/or other customer information that is available to Mpower ECI in response to subpoenas and court orders for their own customer records. When BellSouth receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower ECI end users, BellSouth will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to MpowerECI.

BellSouth shall maintain such information for Mpower Express end users for the same length of time it maintains such information for its own end users. 7.2 Mpower 7.1 Express agrees that BellSouth XxxxXxxxx will respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to Mpower Express end users. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 7.2 Express agrees that in those cases where Mpower Express receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower Express end users, if Mpower does not have the requested information, Mpower Express will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 7.3 In all other instancescases where the timing of the response to the law enforcement agency prohibits Express from having the subpoena or court ordered request redirected to BellSouth by the law enforcement agency, Mpower Express will furnish the official request to BellSouth for providing the call detail information. BellSouth will provide Mpower the call detail records to Express and bill Express for the information. Express agrees to reimburse BellSouth for the call detail information provided. 7.4 Express will provide Express end user and/or other customer information that is available to Mpower Express in response to subpoenas and court orders for their own customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging for Express end user and/or other customer information to Mpower end users, BellSouth will advise Express for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Court Ordered Requests for Call Detail Records and Other Subscriber Information. 7.1 To the extent technically feasible, BellSouth maintains call detail records for Mpower NewSouth end users for limited time periods and can respond to subpoenas and court ordered requests for this information. BellSouth shall maintain such information for Mpower NewSouth end users for the same length of time it maintains such information for its own end users. 7.2 Mpower NewSouth agrees that BellSouth will respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to Mpower NewSouth end users. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower NewSouth telecommunications services for resale or providing to Mpower NewSouth the local switching function, then Mpower NewSouth agrees that in those cases where Mpower NewSouth receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower NewSouth end users, if Mpower NewSouth does not have the requested information, Mpower NewSouth will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 In all other instances, Mpower NewSouth will provide Mpower NewSouth end user and/or other customer information that is available to Mpower NewSouth in response to subpoenas and court orders for their own customer records. When BellSouth receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower NewSouth end users, BellSouth will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to MpowerNewSouth.

Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the requestbona fide requesting party. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 7.2 BTI agrees that in those cases where Mpower BTI receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower BTI end users, if Mpower does not have the requested information, Mpower BTI will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 7.3 In all other instancescases where the timing of the response to the law enforcement agency prohibits BTI from having the subpoena or court ordered request redirected to BellSouth by the law enforcement agency, Mpower BTI will furnish the official request to BellSouth for providing the call detail information. BellSouth will provide Mpower the call detail records to BTI and bill BTI a reasonable rate for the information. BTI agrees to reimburse BellSouth for the call detail information provided. 7.4 BTI will provide BTI end user and/or other customer information that is available to Mpower BTI in response to subpoenas and court orders for their own customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging for BTI end user and/or other customer information to Mpower end users, BellSouth will advise BTI for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower NA Communications telecommunications services for resale or providing to Mpower NA Communications the local switching function, then Mpower NA Communications agrees that in those cases where Mpower NA Communications receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower NA Communications end users, if Mpower NA Communications does not have the requested information, Mpower NA Communications will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 In all other instances, Mpower NA Communications will provide Mpower NA Communications end user and/or other customer information that is available to Mpower NA Communications in response to subpoenas and court orders for their own customer records. When BellSouth receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower NA Communications end users, BellSouth will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to MpowerNA Communications.

Court Ordered Requests for Call Detail Records and Other Subscriber Information. 7.1 To the extent technically feasible, BellSouth maintains call detail records for Mpower Light Networks end users for limited time periods and can respond to subpoenas and court ordered requests for this information. BellSouth shall maintain such information for Mpower Light Networks end users for the same length of time it maintains such information for its own end users. 7.2 Mpower Light Networks agrees that BellSouth XxxxXxxxx will respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to Mpower Light Networks end users. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower Light Networks telecommunications services for resale or providing to Mpower Light Networks the local switching function, then Mpower Light Networks agrees that in those cases where Mpower Light Networks receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower Light Networks end users, if Mpower Light Networks does not have the requested information, Mpower Light Networks will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 In all other instances, Mpower Light Networks will provide Mpower Light Networks end user and/or other customer information that is available to Mpower Light Networks in response to subpoenas and court orders for their own customer records. When BellSouth receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower Light Networks end users, BellSouth will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to MpowerLight Networks.

BellSouth shall maintain such information for Mpower Sprint end users for the same length of time it maintains such information for its own end users. 7.2 Mpower 5.1 Sprint agrees that BellSouth will respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to Mpower Sprint end users. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 5.2 Sprint agrees that in those cases where Mpower Sprint receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower Sprint end users, if Mpower does not have the requested information, Mpower Sprint will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing Billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 5.3 In all other instancescases where the timing of the response to the law enforcement agency prohibits Sprint from having the subpoena or court ordered request redirected to BellSouth by the law enforcement agency, Mpower Sprint will furnish the official request to BellSouth for providing the call detail information. BellSouth will provide Mpower the call detail records to Sprint and xxxx Sprint for the information. Sprint agrees to reimburse BellSouth for the call detail information provided. 5.4 Sprint will provide Sprint end user and/or other customer information that is available to Mpower Sprint in response to subpoenas and court orders for their own customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging for Sprint end user and/or other customer information to Mpower end users, BellSouth will advise Sprint for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

Court Ordered Requests for Call Detail Records and Other Subscriber Information. 7.1 To the extent technically feasible, BellSouth maintains call detail records for Mpower ITC/\DeltaCom end users for limited time periods and can respond to subpoenas and court ordered requests for this information. BellSouth shall maintain such information for Mpower ITC/\DeltaCom end users for the same length of time it It maintains such information for its own end users.. Florida 7.2 Mpower 7.1 ITC/\DeltaCom agrees that BellSouth will respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to Mpower ITC/\DeltaCom end users. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower telecommunications services for resale or providing to Mpower the local switching function, then Mpower 7.2 ITC/\DeltaCom agrees that in those cases where Mpower ITC/\DeltaCom receives subpoenas or court ordered requests regarding for call detail records for targeted telephone numbers belonging to Mpower ITC/\DeltaCom end users, if Mpower does not have the requested information, Mpower ITC/\DeltaCom will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. ITC/\DeltaCom agrees to reimburse BellSouth for the call detail information provided. 7.4 ITC/\DeltaCom will provide ITC/\DeltaCom end user and/or other customer information that is available to Mpower ITC/\DeltaCom in response to subpoenas and court orders for their own customer records. When BellSouth receives will redirect subpoenas or and court ordered requests regarding targeted telephone numbers belonging ITC/\DeltaCom end user and/or other customer information to Mpower end users, BellSouth will advise ITC/\DeltaCom for the purpose of providing this information to the law enforcement agency initiating the request to redirect the subpoena or court ordered request to Mpoweragency.

BellSouth shall maintain such information for Mpower BroadRiver end users for the same length of time it maintains such information for its own end users. 7.2 Mpower BroadRiver agrees that BellSouth will respond to subpoenas and court ordered requests delivered directly to BellSouth for the purpose of providing call detail records when the targeted telephone numbers belong to Mpower BroadRiver end users. BellSouth will immediately notify BroadRiver upon receipt of any subpoenas or court ordered requests to deliver call detail records when the targeted numbers belong to BroadRiver end users. Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower BroadRiver telecommunications services for resale or providing to Mpower BroadRiver the local switching function, then Mpower BroadRiver agrees that in those cases where Mpower BroadRiver receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower BroadRiver end users, if Mpower BroadRiver does not have the requested information, Mpower BroadRiver will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. When BellSouth receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower BroadRiver end users, BellSouth will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to MpowerBroadRiver.

Billing for such requests will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.3 Where BellSouth is providing to Mpower CTES telecommunications services for resale or providing to Mpower CTES the local switching function, then Mpower CTES agrees that in those cases where Mpower CTES receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower CTES end users, if Mpower CTES does not have the requested information, Mpower CTES will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to BellSouth. Where the request has been forwarded to BellSouth, billing for call detail information will be generated by BellSouth and directed to the law enforcement agency initiating the request. 7.4 In all other instances, Mpower CTES will provide Mpower CTES end user and/or other customer information that is available to Mpower CTES in response to subpoenas and court orders for their own customer records. When BellSouth receives subpoenas or court ordered requests regarding targeted telephone numbers belonging to Mpower CTES end users, BellSouth will advise the law enforcement agency initiating the request to redirect the subpoena or court ordered request to MpowerCTES.
