Covenant to Run with the Land. All the covenants, agreements, conditions and undertakings in this Lease shall extend and inure to and be binding upon the heirs, executors, administrators, distributes, lessees, successors and assigns ofeach ofthe parties hereto, the same as ifthey were in every case named and expressed, and the same shall be construed as covenants running with the land. Wherever in this Lease reference is made to any ofthe parties hereto, it shall be held to include and apply to, wherever applicable, also the heirs, executors, administrators, distributes, lessees, successors and assigns ofeach such party, the same as ifin each and every case so expressed.

Covenant to Run with the Land. As theoperation, maintenance and repair of the Project improvements and thedescribed riparian irrigation system for the Project shall be used for protection of the property, the parties intend this Agreement to run with the land and to be binding upon allsuccessors in interest totheparties without restriction, except as to term as written in the provisions for Length of Agreement.

The City and the Owner hereby declare their express intent that the covenants, reservations and restrictions set forth herein shall be deemed covenants running with the land and shall pass to and be binding upon the Owner’s successors in title to the project. Each and every contract, deed, or other instrument hereafter executed covering or conveying the project or any portion thereof shall conclusively be held to have been executed, delivered and accepted subject to such covenants, reservations, and restrictions, regardless of whether such covenants, reservations and restrictions are set forth in such contract, deed or other instruments. In particular, this Covenant is subject to the requirements at HUD’s Section 504 regulation at 24 C.F.R. § 8.50(c).

  • Covenants Run with the Land All of the grants, covenants, terms, provisions and conditions herein shall run with the Premises, shall be binding upon Borrower and shall inure to the benefit of Lender, subsequent holders of this Security Instrument and their successors and assigns. Without limitation to any provision hereof, the term “Borrower” shall include and refer to the borrower named herein, any subsequent owner of the Property, and its respective heirs, executors, legal representatives, successors and assigns.   • Compliance with the Agreement Within 10 days of this Agreement, the board of directors of the Bank shall appoint a committee (the “Compliance Committee”) to monitor and coordinate the Bank’s compliance with the provisions of this Agreement. The Compliance Committee shall include a majority of outside directors who are not executive officers or principal shareholders of the Bank, as defined in Sections 215.2(e)(1) and 215.2 (m)(1) of Regulation O of the Board of Governors (12 C.F.R. §§ 215.2(e)(1) and 215.2(m)(1). At a minimum, the Compliance Committee shall meet at least monthly, keep detailed minutes of each meeting, and report its findings to the board of directors of the Bank.
