Covenants to Run with the Property. The parties hereto agree that the covenants and obligations contained herein shall run with the Property, and further declare that the Property will be owned, used, occupied, and conveyed subject to the covenants and obligations set forth herein, all of which are binding on all persons owning or acquiring any right, title or interest in the Property and their respective heirs, successors, personal representatives and assigns.

Covenants to Run with the Property. (a) This Deed Rider, including all restrictions, rights and covenants contained herein, is an affordable housing restriction as that term is defined in Section 31 of Chapter 184 of the Massachusetts General Laws, having the benefit of Section 32 of such Chapter 184, and is enforceable as such. This Xxxx Xxxxx has been approved by the Director of DHCD.
Covenants to Run with the Property. The covenants, easements and restrictions set out in this Agreement shall be registered on title to the Property by the Municipality and shall run with the Property and ensure to the benefit of and be binding upon the parties hereto and their heirs, executors, administrators, successors and assigns, as the case may be.
Covenants to Run with the Property. The Parties agree that this Agreement runs with the Property, including any subsequent approved amendments to a Final Plat of all, or a portion of the Property. This Agreement is also binding upon and inures to the benefit of the Parties hereto, their respective personal representatives, heirs, successors, grantees and assigns. It is agreed that all Improvements required pursuant to this Agreement touch and concern the Property regardless of whether such Improvements are located on the Property. Assignment of interest within the meaning of this Section specifically include, but not be limited to, a conveyance or assignment of any portion of the Developer’s legal or equitable interest in the Property, as well as any assignment of the Developer’s rights to develop the Property under the terms and conditions of this Agreement.

  • Covenants Running with the Land All Obligations contained in this Mortgage are intended by Mortgagor and Mortgagee to be, and shall be construed as, covenants running with the Land. As used herein, “Mortgagor” shall refer to the party named in the first paragraph of this Mortgage and to any subsequent owner of all or any portion of the Mortgaged Property. All Persons who may have or acquire an interest in the Mortgaged Property shall be deemed to have notice of, and be bound by, the terms of the Credit Agreement and the other Loan Documents; provided, however, that no such party shall be entitled to any rights thereunder without the prior written consent of Mortgagee.

  • Compliance with the Law The Parties agree to comply fully with all applicable federal, state, and local statutes, ordinances, rules, and regulations applicable to their entity in connection with the programs contemplated under this Agreement.

  • Land Covenants This contract is subject to the requirements of Title VI of the Civil Rights Act of 1964 (P. L. 88-352) and 24 CFR 570.601 and 570.602. In regard to the sale, lease, or other transfer of land acquired, cleared or improved with assistance provided under this contract, the Subrecipient shall cause or require a covenant running with the land to be inserted in the deed or lease for such transfer, prohibiting discrimination as herein defined, in the sale, lease or rental, or in the use or occupancy of such land, or in any improvements erected or to be erected thereon, providing that the Grantee and the United States are beneficiaries of and entitled to enforce such covenants. The Subrecipient, in undertaking its obligation to carry out the program assisted hereunder, agrees to take such measures as are necessary to enforce such covenant, and will not itself so discriminate.
