Common use of Criminal Charges and Conviction Clause in Contracts

Criminal Charges and Conviction. 21.4.1 The Parties recognize that action of a Member may result in disciplinary action or criminal action or both. The Parties further recognize that a criminal charge or conviction is not in itself grounds for discipline or dismissal. Any disciplinary action which follows from the events that give rise to the charge or conviction shall be subject to all the protection of this Agreement. 21.4.2 In the event that a Member is accused of an offence which requires a court appearance, he/she shall be granted leave of absence with salary and, if applicable, benefits, until the earlier of the end of the appointment or the end of the court appearance. In the event that the accused Member is jailed awaiting a court appearance, he/she shall receive leave without pay. 21.4.3 As far as circumstances allow, and consistent with the academic mission of the University or the safety and security of its students, a Member who has been charged or convicted shall continue to pursue his/her normal University duties.
