Dangerous Situations. 40.08 When an employee refuses to work in cases of alleged dangerous situations in accordance with Section 82.1 of the Canada Labour Code, the employee shall not be disciplined unless the employee continues to refuse to work after the Canada Labour Safety Officer has deemed the situation safe. Employees shall not refuse other reasonable work assignments while dangerous situations are being investigated. The Company shall not assign another employee to do the work assignment until a union member and a Company member of the Safety Committee have investigated the situation and deemed it to be safe.
