Emergency Situations. If the condition is an emergency, this will be communicated to the Contractor with the request that corrections are to be accomplished immediately. The Contractor shall respond to the notice in emergency situations within twenty-four hours. If the Contractor fails to respond within this time limit, the Owner may correct the defect and charge the Contractor for the Work. If it is determined the complaint is not the responsibility of the Contractor, the Contractor shall be promptly paid for the cost of the corrective work. The Contractor shall give notice in writing to the Owner when corrections have been completed.

Emergency Situations. 2.4.1 If the Contract Administrator or Owner determines, in their sole and absolute discretion, that there is an emergency situation, then the Contract Administrator or Owner, as applicable, may instruct the Contractor to take action to remedy the situation verbally or in writing. If such instruction is verbal, the Contract Administrator or Owner, as applicable, shall provide timely confirmation of such instruction in writing. If the Contractor does not take timely action, or if the Contractor is not available, the Contract Administrator or Owner may direct others to remedy the situation. If the emergency situation is the fault of the Contractor, the remedial Work shall be done at the cost of the Contractor and without any extension of the Contract Time.
Emergency Situations. For the purposes of this PA, emergencies are defined as occurrences that require emergency highway system and facility repairs that are necessary to 1) protect the life, safety, or health of the public; 2) minimize the extent of damage to the highway system and facilities; 3) protect remaining highway facilities; or 4) restore essential traffic. The following stipulations apply to emergency situations:
A. Repairs to address emergency situations as defined above can occur regardless of funding category and permit requirements, and regardless of declarations made by federal, state, or local agencies.
B. If the emergency repair action could affect historic properties, NCDOT’s cultural resource staff shall notify FHWA, USACE, and SHPO via email, and the Tribes by the acceptable methods noted in the Tribal Protocol (Attachment E) prior to any work taking place. The SHPO and any tribe that may attach religious and cultural significance to historic properties likely to be affected shall have 72 hours to respond. If no response is received within 72 hours, repair work shall proceed.
C. For emergency actions where the repair must be made within the first thirty (30) days of the occurrence of the event that caused the emergency or the declaration of the emergency by an appropriate authority, the processing of environmental documentation shall happen concurrently or after the fact. In these cases, NCDOT shall comply with the procedures in Stipulations IV and V, as appropriate, of this PA to the extent possible, but the reviews shall likely be conducted after the emergency work is completed.
D. For emergency actions taking longer than thirty (30) days for repair, NCDOT shall comply with the procedures in Stipulation IV and V, as appropriate, of this PA.
E. Written notification of an emergency action shall be provided to SHPO and lead federal agencies. The notice shall be clearly and prominently marked as an emergency notification and shall include an explanation of how the action meets the requirements for emergency as defined herein. The notice shall also include a brief description of the eligibility and/or significance of the resource(s) involved, the nature, effect, and anticipated effect of the emergency action on the resource(s), and the anticipated time frame available for comment.

The Design-Builder shall give notice in writing to the Owner when corrections have been completed.
Emergency Situations. All time during the on-site workday not assigned to direct student- teacher classroom time will be available for assignment at the discretion of the building principal or immediate supervisor when needed due to emergency situations. An emergency situation is a temporary unexpected set of circumstances that constitute a threat to students or employees. An emergency will not extend beyond a period of ten (10) duty days unless extended by an act of the Board of Education. Before assigning unit members to emergency supervision duty, the site principal or designees shall first ask for volunteers and shall assign all volunteers, if any, before any other unit members are assigned to emergency supervision.

If the CM/GC fails to respond within this time limit, the Owner may correct the defect and charge the CM/GC for the Work. If it is determined the complaint is not the responsibility of the CM/GC, the CM/GC shall be promptly paid for the cost of the corrective work. The CM/GC shall give notice in writing to the Owner when corrections have been completed.
Emergency Situations. In case of a medical emergency caused by pregnancy, the teacher shall be granted a leave, as otherwise provided herein, immediately upon her request and certification of the emergency from an attending physician.
Emergency Situations. In the event of a local emergency situation such as a transit strike or a natural disaster which adversely affects an employee’s ability to commute to the workplace, the parties agree to immediately discuss possible temporary telework arrangements for affected employee(s).
Emergency Situations. Whenever a Party becomes aware of any special water quantity or quality problems constituting an emergency that requires an immediate response, it shall notify and consult directly with the party(ies) concerned and the Joint Committee without delay in order to take appropriate remedial action.
