Common use of Dark Fiber Transport Clause in Contracts

Dark Fiber Transport. Subject to the conditions set forth in Section 1 of this Attachment and upon request by Hypercube, Verizon shall provide Hypercube with access to Dark Fiber Transport in accordance with, and subject to, the rates, terms and conditions set forth in Verizon’s DTE MA No. 17 Tariff, as amended from time to time, that relate to or concern Dark Fiber Transport, and Verizon shall do so regardless of whether or not such rates, terms and conditions are effective. Verizon will provide Hypercube access to Dark Fiber Transport in accordance with, but only to the extent required by, the Federal Unbundling Rules.

Dark Fiber Transport. ‌ Subject to the conditions set forth in Section 1 of this Attachment and upon request by Hypercube365, Verizon shall provide Hypercube 365 with access to Dark Fiber Transport in accordance with, and subject to, the rates, terms and conditions set forth in Verizon’s DTE MA No. 17 Tariff, as amended from time to time, that relate to or concern Dark Fiber Transport, and Verizon shall do so regardless of whether or not such rates, terms and conditions are effective. Verizon will provide Hypercube 365 access to Dark Fiber Transport in accordance with, but only to the extent required by, the Federal Unbundling Rules.

Subject to the conditions set forth in Section 1 of this Attachment and upon request by HypercubeInteleTel, Verizon shall provide Hypercube InteleTel with access to Dark Fiber Transport in accordance with, and subject to, the rates, terms and conditions set forth in Verizon’s DTE MA No. 17 Tariff, as amended from time to time, that relate to or concern Dark Fiber Transport, and Verizon shall do so regardless of whether or not such rates, terms and conditions are effective. Verizon will provide Hypercube InteleTel access to Dark Fiber Transport in accordance with, but only to the extent required by, the Federal Unbundling Rules.

Verizon will provide Hypercube Talk America access to Dark Fiber Transport in accordance with, but only to the extent required by, the Federal Unbundling Rules.

Verizon will provide Hypercube dishNet access to Dark Fiber Transport in accordance with, but only to the extent required by, the Federal Unbundling Rules.

Subject to the conditions set forth in Section 1 of this Attachment and upon request by HypercubeSelectel, Verizon shall provide Hypercube Selectel with access to Dark Fiber Transport in accordance with, and subject to, the rates, terms and conditions set forth in Verizon’s DTE MA No. 17 Tariff, as amended from time to time, that relate to or concern Dark Fiber Transport, and Verizon shall do so regardless of whether or not such rates, terms and conditions are effective. Verizon will provide Hypercube Selectel access to Dark Fiber Transport in accordance with, but only to the extent required by, the Federal Unbundling Rules.

Subject to the conditions set forth in Section 1 of this Attachment and upon request by HypercubeQuantumShift, Verizon shall provide Hypercube QuantumShift with access to Dark Fiber Transport in accordance with, and subject to, the rates, terms and conditions set forth in Verizon’s DTE MA No. 17 Tariff, as amended from time to time, that relate to or concern Dark Fiber Transport, and Verizon shall do so regardless of whether or not such rates, terms and conditions are effective. Verizon will provide Hypercube QuantumShift access to Dark Fiber Transport in accordance with, but only to the extent required by, the Federal Unbundling Rules.

Verizon will provide Hypercube PacOptic access to Dark Fiber Transport in accordance with, but only to the extent required by, the Federal Unbundling Rules.

Dark Fiber Transport. ‌ Subject to the conditions set forth in Section 1 of this Attachment and upon request by HypercubeSynergem, Verizon shall provide Hypercube Synergem with access to Dark Fiber Transport in accordance with, and subject to, the rates, terms and conditions set forth in Verizon’s DTE MA No. 17 Tariff, as amended from time to time, that relate to or concern Dark Fiber Transport, and Verizon shall do so regardless of whether or not such rates, terms and conditions are effective. Verizon will provide Hypercube Synergem access to Dark Fiber Transport in accordance with, but only to the extent required by, the Federal Unbundling Rules.
