Common use of Dark Fiber Transport Clause in Contracts

Dark Fiber Transport. ‌ Subject to the conditions set forth in Section 1 of this Attachment and upon request by dishNet, Verizon shall provide dishNet with access to Dark Fiber Transport in accordance with, and subject to, the rates, terms and conditions set forth in Verizon’s DTE MA No. 17 Tariff, as amended from time to time, that relate to or concern Dark Fiber Transport, and Verizon shall do so regardless of whether or not such rates, terms and conditions are effective. Verizon will provide dishNet access to Dark Fiber Transport in accordance with, but only to the extent required by, the Federal Unbundling Rules.

Dark Fiber Transport. ‌ Subject to the conditions set forth in Section 1 of this Attachment and upon request by dishNetQuantumShift, Verizon shall provide dishNet QuantumShift with access to Dark Fiber Transport in accordance with, and subject to, the rates, terms and conditions set forth in Verizon’s DTE MA No. 17 Tariff, as amended from time to time, that relate to or concern Dark Fiber Transport, and Verizon shall do so regardless of whether or not such rates, terms and conditions are effective. Verizon will provide dishNet QuantumShift access to Dark Fiber Transport in accordance with, but only to the extent required by, the Federal Unbundling Rules.

Dark Fiber Transport. ‌ Subject to the conditions set forth in Section 1 of this Attachment and upon request by dishNetHypercube, Verizon shall provide dishNet Hypercube with access to Dark Fiber Transport in accordance with, and subject to, the rates, terms and conditions set forth in Verizon’s DTE MA No. 17 Tariff, as amended from time to time, that relate to or concern Dark Fiber Transport, and Verizon shall do so regardless of whether or not such rates, terms and conditions are effective. Verizon will provide dishNet Hypercube access to Dark Fiber Transport in accordance with, but only to the extent required by, the Federal Unbundling Rules.

Dark Fiber Transport. ‌ Subject to the conditions set forth in Section 1 of this Attachment and upon request by dishNetTalk America, Verizon shall provide dishNet Talk America with access to Dark Fiber Transport in accordance with, and subject to, the rates, terms and conditions set forth in Verizon’s DTE MA No. 17 Tariff, as amended from time to time, that relate to or concern Dark Fiber Transport, and Verizon shall do so regardless of whether or not such rates, terms and conditions are effective. Verizon will provide dishNet Talk America access to Dark Fiber Transport in accordance with, but only to the extent required by, the Federal Unbundling Rules.

Verizon will provide dishNet InteleTel access to Dark Fiber Transport in accordance with, but only to the extent required by, the Federal Unbundling Rules.

Dark Fiber Transport. ‌ Subject to the conditions set forth in Section 1 of this Attachment and upon request by dishNetPacOptic, Verizon shall provide dishNet PacOptic with access to Dark Fiber Transport in accordance with, and subject to, the rates, terms and conditions set forth in Verizon’s DTE MA No. 17 Tariff, as amended from time to time, that relate to or concern Dark Fiber Transport, and Verizon shall do so regardless of whether or not such rates, terms and conditions are effective. Verizon will provide dishNet PacOptic access to Dark Fiber Transport in accordance with, but only to the extent required by, the Federal Unbundling Rules.

Dark Fiber Transport. ‌ Subject to the conditions set forth in Section 1 of this Attachment and upon request by dishNetCitrix, Verizon shall provide dishNet Citrix with access to Dark Fiber Transport in accordance with, and subject to, the rates, terms and conditions set forth in Verizon’s DTE MA No. 17 Tariff, as amended from time to time, that relate to or concern Dark Fiber Transport, and Verizon shall do so regardless of whether or not such rates, terms and conditions are effective. Verizon will provide dishNet Citrix access to Dark Fiber Transport in accordance with, but only to the extent required by, the Federal Unbundling Rules.

Dark Fiber Transport. ‌ Subject to the conditions set forth in Section 1 of this Attachment and upon request by dishNet365, Verizon shall provide dishNet 365 with access to Dark Fiber Transport in accordance with, and subject to, the rates, terms and conditions set forth in Verizon’s DTE MA No. 17 Tariff, as amended from time to time, that relate to or concern Dark Fiber Transport, and Verizon shall do so regardless of whether or not such rates, terms and conditions are effective. Verizon will provide dishNet 365 access to Dark Fiber Transport in accordance with, but only to the extent required by, the Federal Unbundling Rules.

Verizon will provide dishNet Synergem access to Dark Fiber Transport in accordance with, but only to the extent required by, the Federal Unbundling Rules.

Verizon will provide dishNet Selectel access to Dark Fiber Transport in accordance with, but only to the extent required by, the Federal Unbundling Rules.
