Data Certification. 4.15.4.1 The Contractor shall certify all data pursuant to 42 CFR 438.606. The data that must be certified include, but are not limited to, Enrollment information, Encounter Data, and other information required by the State and contained in Contracts, proposals and related documents. The data must be certified by one of the following: the Contractor’s Chief Executive Officer, the Contractor’s Chief Financial Officer, or an individual who has delegated authority to sign for, and who Reports directly to the Contractor’s Chief Executive Officer or Chief Financial Officer. The certification must attest, based on best knowledge, information, and belief, as follows:
4.15.4.1.1 To the accuracy, completeness and truthfulness of the data.
4.15.4.1.2 To the accuracy, completeness and truthfulness of the documents specified by the State.
4.15.4.2 The Contractor shall submit the certification concurrently with the certified data.
Data Certification. Pursuant to 42 CFR 438.604 and 42 CFR 438.606, MCPs are required to provide certification as to the accuracy, completeness, and truthfulness of data and documents submitted to ODJFS which may affect MCP payment.
Data Certification. The Contractor must comply with the required format as described in this Agreement and published by GCBH and/or DSHS. Data includes encounters documenting services paid for by GCBH and delivered to Individuals through the Contractor during a specified reporting period as well as other data per the GCBH and/or DSHS Data Dictionary and Service Encounter Reporting Instructions (SERI). This data is used for: federal reporting (42 CFR 438.242(b) (1)); rate setting and risk adjustment; service verification, managed care quality improvement program; utilization patterns and access to care; DSHS hospital rate setting; and research studies.
13.1 1.1 Any information and/or data required by this Agreement and submitted to GCBH must be certified by one of the following:

Data Certification a. By July 1 of each year, the Health Plan shall deliver to the Agency a certification by an independent auditor that the PM data reported for the previous year (Measurement Year) have been fairly and accurately presented. This certification should accompany the PM data.
b. The Health Plan shall submit and attest to the accuracy and completeness of data from all subcontracted entities, including, but not limited to, behavioral health managed care organizations, disease management organizations and laboratories as described in Section XII, A.,of the Health Plan Model Contract. In no instance will separate, direct submission of data to the Agency from such entities be permitted.
Data Certification. Pursuant to 42 CFR 438.604 and 42 CFR 438.606, MCPs are required to provide certification as to the accuracy, completeness, and truthfulness of data and documents submitted to ODJFS which may affect MCP payment.
a. MCP Submissions: MCPs must submit the appropriate ODJFS-developed certification concurrently with the submission of the following data or documents:
i. Encounter Data [as specified in the Data Quality Appendix (Appendix L)]
ii. Prompt Pay Reports [as specified in the Fiscal Performance Appendix (Appendix J)]
iii. Cost Reports [as specified in the Fiscal Performance Appendix (Appendix J)]

Data includes encounters documenting services paid for by Great Rivers and delivered to clients during a specified reporting period, as well as other data set out in the Great Rivers and HCA Data Dictionary and Service Encounter Reporting Instructions (SERI). This data is used for federal reporting (42 CFR 438.242(b) (1)); rate setting and risk adjustment; service verification; managed care quality improvement program; utilization patterns and access to care; HCA hospital rate setting; and research studies.
10.6.2. Any information and/or data required by this Contract and submitted to Great Rivers must be certified by the Contractor as follows (42 CFR § 438.242(b)(2) and 42 CFR § 438.600 through 606):

10.6.2.1.1. The Contractor’s Chief Executive Officer.
10.6.2.1.2. The Contractor’s Chief Financial Officer.
10.6.2.1.3. An individual who has received delegated authority to sign for, and who reports directly to, the Contractor’s Chief Executive Officer or Chief Financial Officer.
10.6.2.2. The Contractor’s certification must attest, based on best knowledge, information, and belief, to the accuracy, completeness and truth of the information and/or data.
10.6.2.3. Using the form provided by Great Rivers, the Contractor’s data certification report is due to Great Rivers within ten (10) days following the end of each month.
Data Certification. As promptly as practicable after the date of this Agreement, and in any event on or before August 15, 2013, the Sellers shall cause the Company to deliver to the Buyer the Company Data Package, which materials shall be certified as true and complete by the Company’s chief executive officer. During the Collaborative Data Exploration Period, the Company shall provide the Buyer with access to (a) the final database and the necessary analysis team to run additional data analyses, including analyses not specified in the formal statistical analysis plan, (b) electronic case report forms (eCRFs), patient narratives for serious adverse events and any additional raw data relating to (i) individual patients, (ii) subsets of patients, including from analysis groups pre-specified in the SAP, and (iii) from the data set as a whole and (c) data to enable a comparison to the two prior Company phase II studies of FibroCaps and to published third party studies of competitive products. In addition, during the Collaborative Data Exploration Period, the Company shall make its officers and employees available, and shall use its Reasonable Best Efforts to make its other representatives available, to the Buyer to facilitate a collaborative exploration of the data set included in the Company Data Package, including interactions as needed with the Company’s scientists, clinicians, regulatory, statistical and other internal experts. During the Collaborative Data Exploration Period, the Buyer shall be permitted to consult with (and provide the Company Data Package to) external experts engaged by the Buyer who are bound under conditions of confidentiality equivalent to those applicable to the Buyer. Any analyses which are requested by the Buyer outside the scope of pre-specified analyses will be undertaken with agreement from the Company, such agreement not to be unreasonably withheld, conditioned or delayed. The Buyer shall have the Collaborative Data Exploration Period to review the materials contained in the Company Date Package in conjunction with the Sellers and, upon the request of the Buyer from time to time but within the Collaborative Data Exploration Period, the Sellers shall cause the Company to meet (in person at the Buyer’s offices or by telephone) with representatives of the Buyer to discuss the contents thereof and any questions the Buyer may have with respect thereto.
