DATA OWNSHIP and COPYRIGHT Sample Clauses

DATA OWNSHIP and COPYRIGHT. 9.1 rECOrd operates on the basis that biological, biodiversity and geodiversity data are owned by the original recorders who also hold the copyright and intellectual property rights to the recorded information. The only instances in which will not be the case are where the data has been collected as part of a paid contract, in which case the contractee owns the information, or where the copyright has been assigned by the owner to another individual or organisation. This latter instance would normally only happen in cases where the data is passed to another in perpetuity. 9.2 rECOrd will undertake to make attempts to find and contact all recorders/data-suppliers who have passed information to AN Other Organisation in order to obtain licensing agreements from each individual / organisation to the effect that rECOrd is allowed to use the data but that the ownership and copyright remains with the original recorder. Where this is impossible to achieve, for whatever reason, rECOrd will assume that the data may be used as it was passed to the Other Organisation on the basis that it would be used to aid conservation and wildlife within the County. The above strictures should apply to all data entering rECOrd whether this is species, habitat, geological, or personal.
