Deadlines for PILOT to Take Effect. (a) Notwithstanding anything in the Act or this Agreement to the contrary, the Developer shall not have any right to secure a PILOT for Phase 3 through Phase 11 if the PILOT Term for such Phase does not commence on or before December 31, 2034, subject to extension for an Extension Event Delay. (b) Notwithstanding any extensions provided pursuant to this Agreement, the Developer shall not have any right to secure a PILOT for Phase 3 through Phase 11 if the PILOT Term for such Phase does not commence on or before December 31, 2039.

In case the Allottee fails to take possession within the time provided in para 7.2, such Allottee shall continue to be liable to pay maintenance charges as specified in para 7.2.
