Debarment or Conviction. None of the Company or any of its Affiliates, subcontractors or employees (A) has been debarred, (B) is subject to debarment or (C) is the subject of a conviction, in each case pursuant to Section 335a of the United States Federal Food, Drug and Cosmetic Act, as amended.
Debarment or Conviction. Grant Recipient represents and warrants that neither it nor any of its affiliates, nor any entity it is representing have ever been, are, and covenants that until the sponsored event(s) takes place will be debarred, excluded, suspended, sanctioned, or otherwise deemed ineligible to participate in any healthcare program or procurement program, by any competent authority or health care organization or agency. Grant Recipient further represents and warrants that neither it nor any of its affiliates nor any entity it is representing have ever been, are, and covenants that until the sponsored event(s) takes place will be convicted of an act or omission for which a person can be debarred, excluded, suspended, sanctioned, or otherwise deemed ineligible to participate in any healthcare program or procurement program.
