Common use of Decommissioning and Other Costs Clause in Contracts

Decommissioning and Other Costs. Unless a closing of a sale of the Facility occurs pursuant to the exercise by Buyer of the Right of First Offer, Buyer shall not be responsible for any cost of decommissioning or demolition of the Facility or any environmental or other liability associated with the decommissioning or demolition of the Facility without regard to the timing or cause of the decommissioning or demolition.
