Common use of Deemed Delivery Volume Clause in Contracts

Deemed Delivery Volume. For the purposes of invoicing in accordance with § 22.1(b) (Invoices), where the quantity of electricity actually generated is lower than the Contract Quantity and the cause of such shortfall includes but is not limited to non-compliance of the Seller with § 4 (Construction and Commissioning of Facility), § 5 (Forecasting and Outages) § 6 (Metering) and § 7 (Obligations Concerning the Facility), the Deemed Delivery Volume shall be used instead of the quantity of electricity actually generated to calculate the financial settlement price.
