Deemed Notice. You agree and acknowledge that any Confirmations, statements, supplementary PDS, and any other written notices will be deemed to have been properly given or made available if sent to the address (including electronic mail address) last notified to us by you or if posted on or provided through the Website or the Trading Platform.
Deemed Notice. A notice or other communication is deemed given if:
(a) personally delivered, upon delivery;
(b) mailed to an address in Australia, on actual delivery to the addressee, as evidenced by Australia Post documentation;
(c) sent by facsimile (and is other than a notice of termination or suspension of this entire agreement), on the next Business Day after being sent if following transmission the sender receives a transmission confirmation report or if the sender’s machine is not so equipped to issue a transmission confirmation report then upon the sender receiving acknowledgment of receipt.
Deemed Notice. A Notice is deemed given if:
(i) personally delivered, upon delivery;
(ii) posted to an address in Australia, three (3) days after posting;
(iii) sent by facsimile, on the next day after being sent if following transmission the sender receives a transmission report indicating that the facsimile was sent to the addressee’s facsimile number.
Deemed Notice. Any person or entity purchasing or otherwise acquiring any interest in any shares of the Corporation shall be deemed to have notice of and to have consented to the provisions of this Article VII.
Deemed Notice. Any Notices given to any Member in accordance with ------------- this Agreement will be deemed to have been duly given: [a] on the date of receipt if personally delivered, [b] five days after being sent by U.S. mail, postage prepaid, [c] the date of receipt, if sent by registered or certified U.S. mail, postage prepaid, [d] one Business Day after receipt, if sent by confirmed facsimile or telecopier transmission or [e] one Business Day after having been sent by a nationally recognized overnight courier service.
Deemed Notice. Subject to clause 33.5, a Notice given in accordance with this clause 33 is deemed to be given if:
(a) personally delivered, upon delivery;
(b) posted to an address in Australia, three Business Days after posting;
(c) posted to an address outside Australia, 10 Business Days after posting;
(d) sent by facsimile, on the next Business Day after being sent if following transmission the sender receives a transmission report indicating that the facsimile was sent to the addressee’s facsimile number; or
(e) sent by email, on the next Business Day after being sent (as recorded on the device from which the sender sent the email) unless the sender receives an automated message that the email has not been delivered.
Deemed Notice. It is understood and agreed that on and after the First Amendment Effective Date, execution and delivery of this Amendment shall be deemed to satisfy the requirements of Section 2.16 with respect to notice in respect of this Incremental Facility.

(d) sent by email, 2 hours after the sent time (as recorded on the sender’s email server) unless the sender receives a notice from the recipient’s email server that the message has not been delivered to the recipient.
Deemed Notice. All notices given to any Person in accordance with this Agreement will be deemed to have been duly given [a] on the date of receipt if personally delivered, [b] three days after being sent by registered or certified mail, postage prepaid, return receipt requested, [c] when sent by confirmed electronic facsimile transfer or [d] one business day after having been sent by a nationally recognized overnight courier service.
Deemed Notice. Any person or entity purchasing or otherwise acquiring any interest in any Shares of the Company shall be deemed to have notice of and to have consented to the provisions of this Section 5.23.
