Common use of Definition/Jurisdiction Clause in Contracts

Definition/Jurisdiction. The term “grievance” shall mean an allegation by the Union that there has been a breach, misinterpretation, or improper application of this Agreement. The grievance procedure shall not be used to affect changes in the Articles of this Agreement nor those matters not covered by the Agreement. The grievance procedure shall be the sole and exclusive remedy for resolving disputes between the parties. Grievances pertaining to suspension, removal, or termination shall automatically commence at Step 3 of the Grievance Procedure, and are subject to Step 4, Arbitration. The only recourse for a suspension or termination is through the Grievance Procedure; no recourse shall be pursued through any other administrative procedure or board of review.
