Delay or Forbearance Not a Waiver. Owner’s agreement not to exercise, or its delay or failure to exercise, any right under the Agreement or to require strict compliance with any obligation of Design/Builder under the Agreement shall not be a waiver of the right to exercise such right or to insist on such compliance at any other time or on any other occasion.
