Unexcused Failure to Pay. If Owner, without cause or basis hereunder, fails to pay Design/Builder any amounts due and payable to Design/Builder within thirty (30) days after the date established herein for payment of such amounts, then Design/Builder may suspend its Design Services or, as applicable, the Work until payment is made, provided that Design/Builder first gives ten (10) days' written notice to Owner of its intent.
Unexcused Failure to Pay. If Owner, without justifiable cause or basis hereunder, fails to pay Design/Builder any amounts due and payable to Design/Builder within forty-five (45) days after the date established herein for payment of such amounts, then Design/Builder may suspend its Design Services or, as applicable, the Work until payment is made, provided that Design/Builder first gives five (5) days’ written notice to Owner of its intent. Any payment due hereunder which is not made within thirty (60) days after the date due shall bear interest at statutory interest rate set forth in Idaho Code 63-3045.
Unexcused Failure to Pay. 5.4.1 If within forty-five (45) days after the date established herein for payment to the Contractor by the Owner, the Owner, without cause or basis hereunder, fails to pay the Contractor any amount then due and payable to the Contractor, then the Contractor may after seven (7) additional days' written notice to the Owner, and without prejudice to any other available rights or remedies it may have, stop the Work until payment of those amounts due from the Owner have been received. Any payment not made within forty- five (45) days after the date due shall bear interest at the rate of four percent (4%) per annum.
Unexcused Failure to Pay. If Owner, without cause or basis hereunder, fails to pay Design/Builder any amounts due and payable to Design/Builder within twenty (20) days after the date established in this Contract for payment of such amounts, then the payment shall bear interest in accordance with the Florida Prompt Payment Act, as amended. Provided, however, that Owner shall not be liable for interest due on any late or delayed progress payment or final payment caused by any good faith claim or dispute, any discrepancy in quantities, any failure to provide supporting documentation or other information required with the request for payment or as a precondition to payment under the Contract Documents, or due to any payment Owner has a right to withhold or not certify under the Contract Documents.

If the Municipality, without justifiable cause or basis hereunder, fails to pay the Contractor any amounts due and payable to the Contractor within thirty (30) days after the date established herein for payment of such amounts, then the Contractor may suspend its Design, Build, Operate Services or, as applicable, the Work until payment is made, provided that the Contractor first gives five (5) days’ written notice to the Municipality of its intent. Any payment due hereunder which is not made within thirty (30) days after the date due shall bear interest at the rate of _______ percent.
Unexcused Failure to Pay. 5.4.1 If within fifteen (15) days after the date established herein for payment to the Contractor by the Owner, the Owner, without cause or basis hereunder, fails to pay the Contractor any amount then due and payable to the Contractor, then the Contractor may after ten (10) additional days' written notice to the Owner and the Architect, and without prejudice to any other available rights or remedies it may have, stop the Work until payment of those amounts due from the Owner have been received. Late payments shall not accrue interest or other late charges.
Unexcused Failure to Pay. 5.4.1 If within sixty (60) calendar days after the date established herein for payment to the Contractor by the City, the City, without cause or basis hereunder, fails to pay the Contractor any amount then due and payable to the Contractor, then the Contractor may, after ten (10) additional business days' written notice to the City and the City’s appointed representative, and without prejudice to any other available rights or remedies it may have, stop the provision of Work and / or Service(s), and / or Deliverables until payment of those amounts due from the City have been received. Any payment not made within a further sixty (60) calendar days after the date due shall bear an interest at the rate and /or non-payment penalty of no more than four percent (4%) per annum.

If within ten (10) days after the date established herein for COUNTY’s payment to CONTRACTOR, without cause or basis hereunder, fails to pay CONTRACTOR any amount then due and payable to CONTRACTOR, then CONTRACTOR may after seven (7) additional days written notice to COUNTY and the Architect and/or Engineer, and without prejudice to any other available rights or remedies it may have, stop the Work until payment of those amounts due from COUNTY have been received.
