Common use of Delegation by the Authority’s Engineer Clause in Contracts

Delegation by the Authority’s Engineer. (i) The Authority’s Engineer may, by order in writing, delegate any of his duties and responsibilities to suitably qualified and experienced personnel who are accountable to Authority’s Engineer, or may revoke any such delegation, under intimation to the Authority and the Contractor. Provided, however, that the Authority’s Engineer shall be responsible and liable for all actions and omissions of such personnel. (ii) Any failure of the Authority’s Engineer to disapprove any work, Plant or Materials shall not constitute approval, and shall, therefore, not prejudice the right of the Authority to reject the work, Plant or Materials, which is not in accordance with the provisions of this Agreement and the Specifications and Standards. (iii) Notwithstanding anything stated in Clause 18.3 (i) above, the Authority’s Engineer shall not delegate the authority to refer any matter for the Authority’s prior approval wherever required in accordance with the provisions of Clause 18.2. 18.4
