Delivery of Collocated Space. 12.12.1 Ameritech shall provide Requesting Carrier with a single point of contact for all inquiries regarding Collocation. Requesting Carrier shall request space for Collocation by delivering a written request to Ameritech. Each request for Collocation shall include (i) the Premises in which Collocation is requested, (ii) the amount of space requested, (iii) the interoffice transmission facilities Requesting Carrier will require for such space, (iv) the equipment to be housed in such space, (v) Requesting Carrier's anticipated power requirements for the space, (vi) any extraordinary additions or modifications (i.e., security devices, node enclosures, HVAC, etc.) to the space or to the Premises to accommodate Requesting Carrier's collocated equipment, (vii) the specific level of diversity for fiber and power cabling to and from the Collocated space and (viii) the date on which Requesting Carrier intends to initiate service from such space. Ameritech shall notify Requesting Carrier in writing within ten (10) Business Days of receiving Requesting Xxxxxxx's request for Collocation as to whether the requested space is available. If space is not available for Physical Collocation, Ameritech shall specify in its notice to Requesting Carrier when space for Physical Collocation will be made available to Requesting Carrier and shall offer to Requesting Carrier Virtual Collocation Space in accordance with Section 12.12.3. If intraoffice facilities will not be available for Collocation of initial service within three (3) months of receipt of Requesting Carrier's payment of the Initial COBO fee for Physical Collocation, or twelve (12) weeks after receipt of Requesting Carrier's request for Virtual Collocation pursuant to Section 12.12.1, then Ameritech shall provide written notification, within ten (10) Business Days after the initial walkthrough, as to when the intraoffice facilities will be made available.

For more than 5 applications submitted within a 15 day period, the response interval shall be negotiated by the Parties. If space is not available for Physical Collocation, Ameritech CBT shall specify in its notice to Requesting Carrier CLEC when space for Physical Collocation will be made available to Requesting Carrier CLEC and shall offer to Requesting Carrier CLEC Adjacent Collocation or Virtual Collocation Space in accordance with Section 12.12.3Space. 12.12.3 Should CBT determine that the amount of space available is less than that requested by CLEC or is differently configured, CLEC has the option of amending its application to reflect the actual space available. If after the tour, SBC and CLEC do not agree that space for Physical Collocation is unavailable, SBC will be made available file with the state Commission detailed floor plans and/or diagrams of such premises to Requesting Carrier and shall offer to Requesting Carrier the extent that it is accepted by the appropriate State Commission. CLEC may also request Virtual Collocation Space in accordance with Section 12.12.312.15.5. If intraoffice facilities will not be available for Collocation of initial service within three (3) months of receipt of Requesting CarrierCLEC's payment of the Initial COBO fee for Physical Collocation, or twelve (12) weeks after receipt of Requesting CarrierCLEC's request for Virtual Collocation pursuant to Section 12.12.112.15.1, then Ameritech SBC shall provide written notification, within ten (10) Business Days after the initial walkthrough, as to when the intraoffice facilities will be made available.

If intraoffice facilities will not be available for Collocation of initial service within three (3) months of receipt of Requesting Carrier's payment of its collocation application and resubmit the Initial COBO fee for Physical Collocation, or twelve (12) weeks after receipt of Requesting Carrier's request for Virtual Collocation pursuant to Section 12.12.1, then Ameritech shall provide written notification, application within ten (10) Business Days calendar days after being advised of such deficiencies to retain its position in the initial walkthroughcollocation queue, as pursuant to when Section 12.10.5 of this Article XII. 12.10.2.1 CBT shall not object to or deny the intraoffice facilities submitted SBCT Collocation application(s) (a) on the basis of the functionality of specific equipment SBCT desires to collocate without first proving to the Commission that the equipment will not actually be made availableused, at least in part, by SBCT for the purpose of obtaining Interconnection or access to UNEs; (b) on the basis of the safety standards of equipment SBCT desires to collocate without providing to SBCT within five (5) calendar days of the objection or denial a list of all equipment installed within the Premises in question together with an affidavit attesting that all of that equipment meets or exceeds the safety standard that CBT contends SBCT’s equipment fails to meet; or (c) on the basis that collocation arrangement is not technically feasible without providing written justification to SBCT for that decision within five (5) calendar days of the objection or denial. 12.10.3 Should CBT determine that the amount of space available is less than that requested by SBCT or is differently configured, SBCT has the option of applying for this space by amending its application to reflect the actual space available within the specified time frame addressed in Section 12.10.2.

If space for Physical Collocation is immediately available at the time of Requesting Carrier’s Order, Ameritech shall include in its Response to Requesting Carrier notice of such immediate availability. b. If Requesting Carrier’s requested Physical Collocation space is available, Ameritech and Requesting shall have an initial walk-through of such space within the interval specified in the Implementation Plan. Absent Ameritech’s written consent, Requesting Carrier must have at least one authorized employee (i.e., in addition to any authorized vendor) at such walk-through. If during the initial walk-through, Requesting Carrier wishes to modify or change its Request, Requesting Carrier must sign or initial any such modifications or changes and provide Ameritech a change order reflecting same within five (5) Business Days of such initial walk-through. If a change or modification is noted at the initial walk-through, Ameritech shall have no obligation to commence work on Requesting Carrier’s Collocation space until it receives a change order to amend the Request or written confirmation that Requesting Carrier does not wish to pursue such change or modification. Failure to provide Ameritech the change order or written confirmation within the foregoing five (5) Business Day period shall be deemed a Requesting Carrier Delaying Event for the period between the expiration of such five (5) day period and the date of actual receipt by Ameritech. Ameritech shall deliver to Requesting Carrier the requested space on or before the later of(i) one hundred twenty (120) days from Ameritech’s receipt of Requesting Carrier’s Order, (ii) ninety (90) days the date of the initial walk-through and (iii) such other reasonable date that the Parties may agree upon if it is not feasible for Ameritech to deliver to Requesting Carrier such space within the foregoing intervals (such date of delivery referred to as the “Delivery Date”).

Delivery of Collocated Space. 12.12.1 Ameritech CBT shall provide Requesting Carrier CLEC with a single point of contact for all inquiries regarding Collocation. Requesting Carrier CLEC shall request space for Collocation by delivering a written request to AmeritechCBT. Each request for Collocation shall include (i) the Premises in which Collocation is requested, (ii) the amount of space requested, (iii) the interoffice transmission facilities Requesting Carrier CLEC will require for such space, (iv) the equipment to be housed in such space, (v) Requesting CarrierCLEC's anticipated power requirements for the space, (vi) any extraordinary additions or modifications (i.e., security devices, node enclosures, HVAC, etc.) to the space or to the Premises to accommodate Requesting CarrierCLEC's collocated Collocated equipment, (vii) the specific level of diversity for fiber (or other facility as per CLEC's Bona Fide Request) and power cabling to and from the Collocated space and (viii) the date on which Requesting Carrier CLEC intends to initiate service from such space. Ameritech . 12.12.2 For up to 5 applications submitted within a 15 day period, CBT shall notify Requesting Carrier CLEC in writing within ten (10) Business Days of receiving Requesting XxxxxxxCLEC's request for Collocation as to whether the requested space is available. For more than 5 applications submitted within a 15 day period, the response interval shall be negotiated by the Parties. If space is not available for Physical Collocation, Ameritech CBT shall specify in its notice to Requesting Carrier CLEC when space for Physical Collocation will be made available to Requesting Carrier CLEC and shall offer to Requesting Carrier CLEC Adjacent Collocation or Virtual Collocation Space in accordance with Section 12.12.3Space. 12.12.3 Should CBT determine that the amount of space available is less than that requested by CLEC or is differently configured, CLEC has the option of applying for this space by amending its application to reflect the actual space available. If after the tour, SBC-AMERITECH and CLEC do not agree that space for Physical Collocation is unavailable, SBC-AMERITECH will be made available file with the state Commission detailed floor plans and/or diagrams of such premises to Requesting Carrier and shall offer to Requesting Carrier the extent that it is accepted by the appropriate State Commission. CLEC may also request Virtual Collocation Space in accordance with Section 12.12.312.15.5. If intraoffice facilities will not be available for Collocation of initial service within three (3) months of receipt of Requesting CarrierCLEC's payment of the Initial COBO fee for Physical Collocation, or twelve (12) weeks after receipt of Requesting CarrierCLEC's request for Virtual Collocation pursuant to Section 12.12.112.15.1, then Ameritech SBC- AMERITECH shall provide written notification, within ten (10) Business Days after the initial walkthrough, as to when the intraoffice facilities will be made available. 12.15.2 Physical Collocation. (a) If space for Physical Collocation is immediately available at the time of CLEC's request, SBC-AMERITECH shall include in its notice to CLEC: (i) the space to be provided, and (ii) whether SBC-AMERITECH can deliver the space to CLEC by the date set forth in Section 12.15.2(d). (b) At CLEC’s request, SBC-AMERITECH will make cageless collocation available to CLEC in single-bay (10 square feet) or single cabinet (18 square feet) increments. A cageless collocation is one in which CLEC collocates in any unused space that is conditioned to house its equipment. CLEC is not required to construct any enclosure of its equipment. CLEC may locate equipment at any location in the Central Office, up to SBC-AMERITECH’s last unreserved bay space in that central office. In the case of Remote Terminal Cabinet, Controlled Environment Vault or Hut cageless collocation will be offered in increments of one (1) shelf.

CBT’s response will advise CLEC of the specific deficiencies in the application. If space is not available for Physical Collocation, Ameritech CBT shall specify in its notice to Requesting Carrier CLEC when space for Physical Collocation will be made available to Requesting Carrier CLEC and shall offer to Requesting Carrier CLEC Adjacent Collocation or Virtual Collocation Space Space. CLEC must cure any deficiencies in accordance with Section 12.12.3. If intraoffice facilities will not be available for Collocation of initial service within three (3) months of receipt of Requesting Carrier's payment of its collocation application and resubmit the Initial COBO fee for Physical Collocation, or twelve (12) weeks after receipt of Requesting Carrier's request for Virtual Collocation pursuant to Section 12.12.1, then Ameritech shall provide written notification, application within ten (10) Business Days calendar days after being advised of such deficiencies to retain its position in the initial walkthroughcollocation queue. 12.12.2.1 CBT shall not object to or deny the submitted CLEC Collocation application(s) (a) on the basis of the functionality of specific equipment CLEC desires to collocate without first proving to the Commission that the equipment will not actually be used, as at least in part, by CLEC for the purpose of obtaining Interconnection or access to when UNEs; (b) on the intraoffice facilities will be made availablebasis of the safety standards of equipment CLEC desires to collocate without providing to CLEC within five (5) calendar days of the objection or denial a list of all equipment installed within the Premises in question together with an affidavit attesting that all of that equipment meets or exceeds the safety standard that CBT contends CLEC’s equipment fails to meet; or (c) on the basis that collocation arrangement is not technically feasible without providing written justification to CLEC for that decision within five (5) calendar days of the objection or denial. 12.12.3 Should CBT determine that the amount of space available is less than that requested by CLEC or is differently configured, CLEC has the option of applying for this space by amending its application to reflect the actual space available within the specified time frame specified in Section 12.12.2.
