Demonstration of Achieved Cost Savings. Achieved savings shall be measured by subtracting the Measurement-Year Cost of Service (“Measurement-Year COS”) from the Adjusted Benchmark Cost of Service (“Adjusted Benchmark COS”). For the purpose of this section, the “Measurement-Year COS” shall be the adjusted base-rate revenue requirement excluding environmental response costs, low- income heating assistance funds, low-income weatherization program costs, and demand-side management program costs in the test-year period used in any base-rate proceeding occurring subsequent to the Rate-Freeze Period, for rates to be effective prior to July 1, 2010. For the purpose of this section, the “Benchmark COS” shall mean the consolidated distribution cost- of-service established in this Settlement Agreement, excluding the customer share of annual net merger savings, environmental response costs, low-income heating assistance funds, low- income weatherization program costs, and demand-side management program costs, or $127,700,000, escalated by 50 percent of the change in GDPIPD from the year ended June 30, 2003 through the Measurement Year. The escalated Benchmark COS will be added to the product of the escalated Benchmark COS times 30 percent of the growth in weather- normalized firm throughput for the period ended June 30, 2003 through the Measurement Year to determine the Adjusted Benchmark COS. For the purpose of this calculation, the year ending June 30, 2003 weather-normalized firm throughput is 345,400,000 therms.

  • Cost Savings Developer shall work cooperatively with Architect, Construction Manager, subcontractors and District, in good faith, to identify appropriate opportunities to reduce the Project costs and promote cost savings. Any identified cost savings from the Guaranteed Maximum Price shall be identified by Developer, and approved in writing by the District. In the event Developer realizes a savings on any aspect of the Project, such savings shall be added to the Contingency and expended consistent with the Contingency. In addition, any portion of Allowance remaining after completion of the Project shall be added to the Contingency. If any cost savings require revisions to the Construction Documents, Developer shall work with the District and Architect with respect to revising the Construction Documents and, if necessary, obtaining the approval of DSA with respect to those revisions. Developer shall be entitled to an adjustment of Contract Time for delay in completion caused by any cost savings adopted by District pursuant to Exhibit D, if requested in writing before the approval of the cost savings.

  • Cost of Living (COLA) All seniority employees who have completed their appropriate wage progression schedule shall be covered by the provisions of a cost-of-living allowance, as set forth in this Agreement. Employees who have not completed their appropriate wage pro- gression on the effective date of a COLA increase, shall receive the adjustment on a prospective basis on the date they complete their wage progression schedules. The amount of the cost-of-living allowance shall be determined as provided below on the basis of the "Consumer Price Index for Urban Wage Earners and Clerical Workers, CPI-W (Revised Series using 1982-1984 Expenditure Patterns), All Items (1982-84 = 100), published by the Bureau of Labor Statistics, U.S. Department of Labor" and referred to herein as the "Index". Effective August 1, 2019 2024 and every August 1, thereafter during the life of the Agreement, a cost-of-living allowance will be calculated on the basis of the difference between the Index for May 202419 (published June 202419) and every May thereafter, and the base Index for May 202318 (published June 202318) and every May thereafter, as follows: For every two tenths (0.2) point increase in the Index, over and above the base (prior year's) Index plus three percent (3.00%) there will be a one (1) cent increase in the hourly wage rates payable on August 1, 202419 and every August 1 thereafter. These increases shall only be payable if they equal five cents ($.05) in a year. Upon the failure of the parties to agree within sixty (60) days, thereafter, the issue of an appropriate substitute shall be submitted to an arbitrator for determination. The arbitrator's decision shall be final and binding.

  • GMP Cost Limitation The Guaranteed Maximum Price shall not be in excess of the GMP Cost Limitation.

  • Cost of Services Political Subdivision shall share some expenses for the above services, supplies and equipment. Additional elections may lower costs for each entity, and election cancellations may raise costs for each entity. It is understood that other political entities may wish to participate in the use of the County’s electronic voting equipment and polling locations, and it is agreed that Contracting Officer may enter into other contracts with entities for those purposes on terms and conditions generally similar to those set forth in this Agreement. Only the actual expenses directly attributable to this Agreement and any prorated shared expenses may be charged to Political Subdivision, plus a 10% administrative fee.

  • Eligible Costs II.14.1 Eligible costs of the action are costs actually incurred by a beneficiary, which meet the following criteria: – they are incurred during the duration of the action as specified in Article I.2.2 of the agreement, with the exception of costs relating to final reports and certificates on the action’s financial statements and underlying accounts; – they are connected with the subject of the agreement and they are indicated in the estimated overall budget of the action; – they are necessary for the implementation of the action which is the subject of the grant; – they are identifiable and verifiable, in particular being recorded in the accounting records of a beneficiary and determined according to the applicable accounting standards of the country where the beneficiary is established and according to the usual cost-accounting practices of the beneficiary; – they comply with the requirements of applicable tax and social legislation; – they are reasonable, justified, and comply with the requirements of sound financial management, in particular regarding economy and efficiency. The beneficiaries’ accounting and internal auditing procedures must permit direct reconciliation of the costs and revenue declared in respect of the action with the corresponding accounting statements and supporting documents.
