Common use of Department’s Right to Renew Clause in Contracts

Department’s Right to Renew. Upon notice to Contractor at least six months prior to expiration, the Department may renew the Contract for up to three additional years at the same, or lower than, the prices specified in this Contract at its sole option and discretion. Such renewal will be binding on the Contractor and may be in one or multiple year increments at the Department’s sole option. If Contractor agrees to pricing concessions or is obligated to provide alternate pricing terms pursuant to Section 9.7, the renewal will specify the adjusted price. The Department will not be charged any costs for the renewal. The renewal is contingent upon the availability of funds.
