DEPENDENT CONTRACTORS. A Dependent Contractor is a person who owns and operates his own dump truck as described in Schedule "B" Dependent Contractors of the 1979/81 B.C. Road Builders Agreement, and working for a member Company or a Company that has had its certification varied under Section 48 of the Labour Code of B.C.
DEPENDENT CONTRACTORS. Section 1 Definition Section 2 The Company may engage the services of dependent contractors provided the following conditions are complied with: a Dependent Contractor’s Agreement as provided in Appendix attached hereto and forming part of this Agreement is entered into between the Company and the dependent contractor prior to the dependent contractor performing any services for the Company and in respect to those dependent contractors now engaged by the Company not later than fifteen days following the signing of this Agreement. Signed copies of Appendix shall be forwarded to the Union forthwith the dependent contractor shall become and remain a member of the Union in accordance Article Section 2 and 3 herein. He shall be identified on a checkoff list as a dependent contractor, either as a line driver, local or a combination of both a separate seniority list shall be posted at the terminal showing the names and truck numbers of all dependent contractors. A copy of such list shall be forwarded to the Union forthwith in accordance with Article Section 7 , The dependent contractor shall personally and exclusively operate the equipment supplied pursuant to this agreement with the Company, excepting that such equipment shall be operated by an employee of the Company in instances where the equipment requires more than one operator and upon the request of the dependent contractor, in instances where the dependent contractor is absent because of vacations, illness, accident or on leave of absence for reasons acceptable to the Company. Notwithstanding the foregoing, in instances where partnerships existed under the Agreement, such arrangements shall not be affected by this Article. On written demand from the Union the Company must produce proof of ownership or equipment lease agreement by said dependent contractor Section 3 Increases, Decreases In Services In the event the Company increases or reduces the number of operational units within a branch, such increases or reductions shall be made on the basis of one Company unit to one dependent contractor unit. However, the foregoing shall not compel the Company to engage or retain the services of dependent contractors, nor shall the replacement of a dependent contractor with another dependent contractor be a consideration. In the application of (a) of this Section the branch shall be defined as follows: in the line-haul within the jurisdiction of the Local Union in which he is a member (ii) in operations all terminal...
DEPENDENT CONTRACTORS. An Owner Operator/Dependent Contractor is a person who owns and operates his own truck or as defined by the Industrial Relations Act and for the purpose of this Agreement they are one and the same. (i) The terms and conditions of the Standard Teamsters 213 Road Building (Reference) Agreement as applicable to Owner Operators/Dependent Contractors are shown under the appropriate clauses of the main Agreement. (ii) The terms and conditions set out hereunder in this Schedule "B" are the entire agreement for monetary payments and benefits for Owner Operators/Dependent Contractors.
DEPENDENT CONTRACTORS. An Owner Operator/Dependent Contractor is a person who owns and operates his own truck or as defined by the Industrial Relations Act and for the purpose of this Agreement they are one and the same. (i) The terms and conditions of the Standard Teamsters 213 Road Building (Reference) Agreement as applicable to Owner Operators/Dependent Contractors are shown under the appropriate clauses of the main Agreement. (ii) The terms and conditions set out hereunder in this Schedule "B" are the entire agreement for monetary payments and benefits for Owner Operators/Dependent Contractors. (iii) Dependent Contractors must be members in good standing of the Union and be required to supply proof of membership upon being hired. Proof of membership shall be a Union clearance. The Employer shall obtain clearance by telephone, telegram, fax or in writing from the Union Dispatch Office.
DEPENDENT CONTRACTORS. It is understood and agreed that the relationship between the Parties hereunder is that of independent contractors and that nothing in this Agreement shall be construed as authorization for either Seller, on the one hand, or Buyer, or the other hand, to act as agent for the other.

DEPENDENT CONTRACTORS. TOWN (HOURLY RATES) LINE – MILEAGE RATES (1) One-quarter (1/4) hour pre-trip and post trip to be paid for every trailer pickup. (2) For trailers coming in on piggyback and being picked up by line driver, the driver is to be paid from his dispatch time until the time he can leave on his trip (waiting for trailer to be unloaded). (3) Linehaul direct delivery For Lower Mainland – Same rate as city cartage tandem tractor rate. Fuel Clause is now calculated as per Appendix “E”.
DEPENDENT CONTRACTORS. The Company and the Union agree to negotiate the conditions for Dependent Contractors separately and these conditions shall become and remain an "Appendix" of the Collective Agreement.
DEPENDENT CONTRACTORS. Their regular work consists of customer direct long distance bulk pick ups (broker work) destined primarily to the Lambton facility as assigned to the Lambton Dispatch. All new broker work will be offered to D/C drivers first before it can be assigned to the Independent Contractors. The current list of work for D/C to select from will include all inner Company work outside of Canada as provided to the Lambton facility. Al new work that has arrived since November 2004 will be made available for selection. All new projects will be offered first.
