Common use of Design and Construction Clause in Contracts

Design and Construction. Without limiting the Subcontractor’s obligations under the Subcontract or otherwise at law or in equity, the Subcontractor must: design the parts of the Subcontract Works which the Subcontract requires it to design; and construct the Subcontract Works, in a manner which: complies with the requirements of the ESD and WOL Plan; and xxxxxxxxx the achievement of the ESD Principles and the WOL Objectives.
