Construction Works. The Concessionaire shall ensure that construction of building structure of the Bus Terminal Facilities is undertaken in accordance with the design approved by the Independent Engineer in consultation with the Punjab Roadways/PRTC/PIDB or any other body of Punjab Governemnt. Entire construction shall be in conformity with the Technical Specifications and Standards set forth in this document. The development works shall include, but be not limited to, the following: · Preparation of master plan for the entire site for development of Bus Terminal Facilities and Commercial Facilities. · Detailed design & detailed engineering with Good for Construction drawings related to the execution of the Bus Terminal Facilities. · Development of Bus Terminal Elements which shall include the bus bays (alighting, boarding and idle parking), bus circulation area, exit & entry for buses and other components described in subsequent paragraphs of this Schedule. · Passenger Amenities shall include, but be not limited to, shops, kiosks, ticketing counters, tourist information centre, toilets, drinking water xxxxxxxx, waiting halls, seating facilities, dustbins, parking areas for public, private and intermediate public transport, etc and other components described.. · Design and construct supporting infrastructure facilities related to internal roads, curb stones, foot paths, Solid Waste Management, Rain Water Harvesting, Water Supply and Sanitation, Electric Sub Station, solar lighting (if needed), Communication System, Facilities for the differentially-abled persons.
Construction Works. (i) The Developer is required to commence Construction Works only on or after the approval of the Development Plan by JTDCL. (ii) Unless otherwise permitted by JTDCL, no Construction Works shall begin until the Third Party Inspector is in place and has assumed charge. The Developer shall immediately upon commencement of Construction Works notify the Third Party Inspector and JTDCL of the same. (iii) The Developer shall adhere to the approved Developer Plan, Detailed Project Report, Construction Requirements and achieve COD on or before the Scheduled Project Completion Date. If the Developer fails to achieve COD on or before the Scheduled Project Completion Date for any reason other than conditions constituting Force Majeure or for reasons attributable to JTDCL, the Developer shall pay to JTDCL, damages calculated at the rate of 6% (six percent) of the Performance Security, for every month of delay till COD. (iv) The Developer shall, before commencement of Construction Works have requisite organisation and designate and appoint suitable officers / representatives as it may deem appropriate to supervise the Project, to deal with the Third Party Inspector/JTDCL and to be responsible for all necessary exchange of information required pursuant to this Agreement; (v) For the purposes of determining whether the Construction Works are being undertaken in accordance with the Detailed Project Report, Development Plan and Construction Requirements, the Developer shall with due diligence carry out all necessary and periodical Tests at its cost in accordance with the instructions and under the supervision of the Third Party Inspector and the Construction Requirements. (vi) If, as a result of such tests, JTDCL and/or the Third Party Inspector decides that any plant, materials, consumables, design, process, software or workmanship relating to the Project Facility is defective or otherwise not in compliance with the Detailed Project Report, Development Plan, Construction Requirement and Good Industry Practice, JTDCL and/or the Third Party Inspector may reject such materials, consumables, process or workmanship and shall forthwith notify the Developer with reasons for rejection and require correction of such defects within the stipulated time. (vii) The Developer shall make good such notified defects within the stipulated time, and undertake re-testing, if any, at its cost that may be required by JTDCL and/or the Third Party Inspector. Construction Works. (a) If the Tenant, or a contractor engaged by the Tenant, undertakes any construction works at the Property that is a 'construction project' as defined in the WHS Laws (Construction Works), the Landlord hereby appoints the Tenant or the contractor nominated by the Tenant (Tenant's Contractor) as the Principal Contractor in accordance with the WHS Laws for the relevant Construction Works on and from the date the Construction Works commence. (b) The Tenant hereby acknowledges and accepts its appointment as Principal Contractor, and covenants to discharge the obligations of a Principal Contractor contained in the WHS Laws and accepts all liability in respect thereof. (c) The Tenant hereby acknowledges that it has the management and control of the Property, to the extent necessary to discharge the duties imposed on a Principal Contractor by the WHS Laws. (d) The Tenant may authorise the Tenant's Contractor to have the necessary level of management or control of the Property so as to discharge its duties as Principal Contractor for the purposes of the WHS Law so long as the Tenant: (i) provides the Landlord with evidence to the Landlord's satisfaction that the person is able to fulfil the duties of a Principal Contractor under the WHS Law and that the person accepts the engagement; (ii) acknowledges that the Landlord has not undertaken any obligation or assumed any duty of care in relation to any approval (implied or otherwise) of the Tenant's engagement of a Principal Contractor; and (iii) procures that the Tenant's Contractor complies with the obligations under clause 13(e). (e) The Tenant or the Tenant's Contractor (where engaged as Principal Contractor in accordance with clause 13(d)) acknowledges and agrees that the Tenant or the Tenant's Contractor (as the case may be): (i) must ensure the health safety and welfare of all other persons performing the Construction Works; (ii) is the person responsible for the Construction Works for the purposes of the WHS Law at all times until the Construction Works are completed; (iii) must ensure that in carrying out the Construction Works or causing the Construction Work to be carried out, it complies with its obligations under the WHS Law, including, in respect of the Construction Works, as Principal Contractor; (iv) must provide to the Landlord all notices and correspondence concerning work health and safety (including, without limitation, in respect of any notifiable incidents) in connection with the Construction Wo...
