Common use of Design-Build Documents Clause in Contracts

Design-Build Documents. The Design-Build Documents consist of this Agreement between Owner and Design-Builder and its attached Exhibits (hereinafter, the “Agreement”); other documents listed in this Agreement; and Modifications issued after execution of this Agreement. A Modification is (1) a written amendment to the Contract signed by both parties, including the Design-Build Amendment, (2) a Change Order, or (3) a Change Directive.

Design-Build Documents. The Design-Build Documents consist of this Agreement between Owner Manager and Design-Builder and its attached Exhibits (hereinafter, the “"Agreement”"); other documents listed in this Agreement; and Modifications issued after execution of this Agreement. A Modification is (1) a written amendment to the Contract signed by both parties, including the Design-Build Amendment, (2) a Change Order, or (3) a Change Directive.

A Modification is (1) a written amendment to the Contract signed by both parties, including the Design-Build Amendmentthis Agreement , (2) a Change Order, or (3) a Change Directive.

All Modifications must be in writing and signed by Owner or Owner’s authorized representative. The Contract cannot be amended or modified verbally or by conduct of the Parties.
