Design-Builder Non-Impairment Rights Sample Clauses

Design-Builder Non-Impairment Rights. No Design and Construction Requirement Change, other than a Design-Builder requested Design and Construction Requirement Change, shall be made that materially impairs any right, materially impairs the ability to perform, imposes any material additional obligation or liability, or materially increases the costs of the Company hereunder unless the parties agree to appropriate reasonable price and/or other reasonable adjustments in connection with such Design and Construction Requirement Change. The Design-Builder shall have no right to object to such Design and Construction Requirement Change, however, if the Owner affords the Design-Builder any price, schedule, performance and other relief necessary to avoid any such material effect.

  • Solicitations for Subcontracts, Including Procurements of Materials and Equipment In all solicitations either by competitive bidding or negotiation made by the Engineer for work to be performed under a subcontract, including procurements of materials or leases of equipment, each potential subcontractor or supplier shall be notified by the Engineer of the Engineer's obligations under this contract and the Regulations relative to nondiscrimination on the grounds of race, color, or national origin.
