Common use of Design-Builder Proposal Review Clause in Contracts

Design-Builder Proposal Review. Upon receipt of proposals and prior to Design-Builder’s acceptance of any proposal, Design-Builder shall prepare and deliver to the Owner for its review a complete and thorough analysis of the proposals received. Such proposal analysis shall clearly indicate the apparent best proposal from the proposer or proposers determined by Design-Builder to be responsible and responsive and shall be accompanied by a copy of each proposal received. Nothing herein requires Design-Builder to select the lowest price proposal. The risk and cost of Design-Builder's selection of a successful proposer lies exclusively with Design-Builder.
