Common use of Developer Performance of Department Change Clause in Contracts

Developer Performance of Department Change. The Developer will perform the work required to implement the Department Change in a timely manner; provided, that: (i) a Change Order setting forth, among other things, the adjusted scope of the Work and adjustments to the Baseline Schedule and the Technical Requirements, if applicable, will have been mutually agreed upon between the Department and the Developer and issued by the Department; (ii) the Department and the Developer (if applicable) will have identified sufficient funds that may be made available to the Developer to perform the work required to implement the Department Change; and (iii) all necessary Governmental Approvals to commence the Work required to implement the Department Change have been obtained.
