Developer to provide Public Benefits. (a) The Developer must, at its cost and risk, provide the Public Benefits to the City in accordance with this document. (b) The Developer will not be required to commence the carrying out of the Public Benefits before: (i) the commencement of the SLEP Amendment within the meaning of section 34(5) of the Act; and (ii) the granting of a Development Consent for the Development.

(c) A Public Benefit is made for the purposes of this document when the Council receives the full amount of the contribution payable under this document in cash or by unendorsed bank cheque or by deposit by means of electronic funds transfer of cleared funds into the bank account nominated by the Council.
